ENTRY RULES

If you have a biometric passport: as a citizen of Ukraine you can enter Denmark and stay in its territory for 90 days without applying for a temporary residence permit or asylum. 

If you are traveling without a visa, you can usually enter Denmark under the following basic conditions:

• You have a valid passport or other valid travel document. As a citizen of Ukraine, you must have a biometric passport issued on January 12, 2015 or later to be eligible for visa-free entry. If your passport is issued before January 12, 2015, it is not biometric, so you need to have a short-term visa to enter Denmark. The passport or travel document must be valid for three months after the expected date of departure from the Schengen area. In addition, a passport or travel document must be issued within the last 10 years.

• You have the necessary funds to pay for your stay and return trip. The amount of money you need depends on the length of your stay and whether you stay in a hotel or a private home with family or friends. Usually you have to carry 350 Danish kroner (DKK) per day. The amount may be less if you stay in a private house, the owner of which will cover all costs. If you plan to stay at the hotel, you need a larger amount - about 500 Danish kroner per day.

• If necessary, you can justify and document the purpose of your stay in Denmark. The goal can be, for example, visiting friends or family members or a tourist trip.

• You are not registered as an undesirable person in the Schengen Information System (SIS II).

• You have not been expelled from Denmark on the basis of a court decision and you have not been banned from re-entry.

• You have not been included in the UN or EU sanctions lists.

These conditions apply during your entry into and stay in Denmark or another Schengen country. It is important that you can always document that you have the necessary funds to pay for your stay and return trip. Failure to comply with these conditions may deny you entry at the border.

You also have the opportunity to apply for a temporary residence permit in accordance with the Special Law. (A special law was passed for Ukrainians fleeing the war and provides a temporary residence permit for 2 years with the right to work and receive assistance).

If you do not have a biometric passport (you have an old passport in the form of a booklet or only a domestic passport / ID card):

If you do not have a biometric passport, you must have a short-term visa to enter Denmark. If you have not been issued a visa at the Danish mission before arriving at the Danish border, you can apply for a visa at the border (emergency visa).

You must contact the police at the border. The Migration Service will process your application. If you are applying at the border, you must prove that you were not able to apply in advance. Therefore, you may be asked to document that the reason for your entry is unpredictable and necessary.

You also have the opportunity to apply for a temporary residence permit in accordance with the Special Law.

The Danish police issue emergency visas of this category to Ukrainian citizens when they enter Denmark (at the border). An emergency visa is usually issued immediately after entering Denmark. At the same time, due to the significant number of appeals, the time of information processing by the competent authorities has significantly increased. In this regard, the citizen will be asked to submit his / her passport to the police in accordance with the Danish Aliens Act. The visa will be issued in a few days. The embassy asks citizens to take a photo (or have a copy) of their passport before handing it over to the police. The police officer will inform the citizen to apply to the specific police station where the emergency visa will be issued at the agreed time. Until a visa is issued, citizens must stay at the address they provided to the police on arrival (ie the place of departure in Denmark). The Ministry of Foreign Affairs advises to have an accompanying person who lives in Denmark when crossing the border (Germany-Denmark) in such cases. The accompanying person may temporarily vouch for the compatriot and inform that he plans to temporarily detain him.

An emergency visa is issued subject to:

• Your passport or other valid travel document must be valid for three months after the visa expires.

• Your passport or travel document must have been issued within the last 10 years.

• You must have the necessary funds to pay for your stay and return trip. The amount of money required is determined by the Danish diplomatic mission and depends on the length of your stay and whether you stay at a hotel or your family or friends. Usually you have to carry 350 Danish kroner (DKK) per day. If you plan to stay at the hotel, the amount should be more - about 500 Danish kroner per day.

• You must have an international insurance policy to cover possible costs due to health or death, the need for treatment or urgent hospitalization during your stay. The insurance policy must cover all Schengen countries. The minimum policy coverage is 30,000 euros. The insurance policy must be valid for the same period as the visa. The validity of the visa may be reduced if the insurance policy does not cover the entire period of stay.

• You are not on the list of unwanted persons registered in the Schengen Information System (SIS II).

• You were not deported from Denmark and you were not banned from entering.

• You are not on UN or EU sanctions lists.

These conditions are valid at the time of issuance of the visa, as well as when entering and staying in the Schengen area.

If you do not have documents: your identity will be established in cooperation with the Embassy of Ukraine in Denmark.

If you plan to stay longer than 90 days in Denmark and start working and receiving assistance from the government, we recommend that you use the Danish Special Law and obtain a temporary residence permit. The Ministry of Foreign Affairs of Ukraine does not recommend applying for asylum (refugee status).

Remember also that if you are traveling with a biometric passport, which is about to expire, you can apply to any embassy / consulate of Ukraine abroad (in Poland, Germany, etc.) to renew it.

At the same time, the Embassy of Ukraine in Denmark draws attention to the fact that if you have already entered Denmark with available documents and submitted documents to the migration service, you do NOT need to apply to the Embassy to renew your passport or enter child data in the parents' passport. the Danish service to which the documents have been submitted will issue you with an identification card which will temporarily serve as your identity card in the country. The embassy asks you to renew your passport or enter information about the child in urgent cases when you need a valid passport.

HOW TO OBTAIN A TEMPORARY RESIDENCE PERMIT IN DENMARK

On March 16, 2022, the Danish Folketing passed a special bill that allows Ukrainians to legalize their stay in Denmark and obtain the appropriate status of a displaced person under an accelerated procedure. Ukrainians who fled the war and ended up in Denmark will be able to obtain a residence permit immediately, which will allow them to get an education, get a job and receive social benefits.

The normative act stipulates that the residence permit will be issued for a period of two years, with the possibility of extension.

Restrictions related to the COVID-19 coronavirus do not apply to Ukrainian citizens arriving in Denmark under Russian aggression.

HOW TO OBTAIN A TEMPORARY RESIDENCE PERMIT IN DENMARK

This law simplifies the procedure for obtaining a temporary residence permit in Denmark for the following categories of persons:

• citizens of Ukraine who left Ukraine after the Russian invasion of Ukraine on February 24, 2022;

• citizens of Ukraine who lived or had a residence permit in Denmark as of February 24, 2022;

• citizens of Ukraine over 18 years of age who before February 24, 2022 were married to a citizen of Ukraine over 18 years of age (or lived with him / her in a civil marriage), who received a certificate under this Law;

• minor unmarried children of a citizen of Ukraine who have received a certificate under this Law;

• citizens of Ukraine who had close family ties until February 24, 2022, lived together and were dependent on a citizen of Ukraine who received a certificate under this Law after leaving Ukraine;

• citizens of Ukraine who until February 24, 2022 lived in the same family with a citizen of Ukraine, who received a certificate under this Law.

Application for a certificate

The application for a temporary residence permit in Denmark is submitted using the online form "SL1" at the following link: https://blanket.nyidanmark.dk/xform/formularer/sl1b.form.aspx 

It is also possible to fill in the application form by hand.

When completing the application, you will need your passport or other identity document, as well as birth certificates or other identity documents of your children.

Before you start filling out the application, your username (a set of numbers) and a temporary password will be created, which you will need to change in the next step (8 characters from letters and numbers). If you are filling out the online form for the first time, you must select the "Start a new application" option.

If the online form is completed not by the applicant himself but by another person residing in Denmark, the application will need to be accompanied by a power of attorney completed by hand. In this case, such a person must have a CPR number (number in the Danish Central Register of Persons).

Information about children under the age of 18 can be provided in a parent's application. You do not need to fill out a separate application for each child.

A citizen of Ukraine must be in Denmark to apply. He / she has the right to stay in Denmark during the processing of the application. However, if they do not submit their fingerprints and their photograph within 4 weeks of submitting the application, the application shall cease to be valid.

The application may be rejected if it turns out that the citizen of Ukraine has already received a residence permit in another country outside Ukraine. An application may also be rejected if a citizen of Ukraine has been convicted or has committed an offense outside Ukraine for a crime that may lead to deportation, as well as if it poses a threat to state security or is a danger to others due to an infectious disease or serious mental disorder.

Temporary residence permit in Denmark is issued until March 17, 2024. According to this Act, it is possible to extend its validity for one year.

The certificate is revoked if a citizen of Ukraine leaves Denmark for Ukraine for a specific purpose and does not return to Denmark again.

Appeal to the Citizen Service:

After completing the application, you need to make an appointment at the Immigration Centers of the Danish Immigration Agency (Udlændingestyrelsen) to take fingerprints and take a personal photo, at the following link.

The following documents must be brought to the Citizen Service:

- printed receipt of filling in the digital form "SL1" or completed application in paper form;

- passport or other identity document (original together with a copy);

- birth certificates or other identity documents of your children (originals with copies);

- employment contract (if you are offered a job in Denmark);

- refugee certificate or other document that proves that you are recognized as a refugee in Ukraine (if you are not a citizen of Ukraine).

Children whose information is included in the application of one of the parents must also appear at the Citizen Service with their parents.

There is no fee for considering an application for a temporary residence permit in Denmark in connection with moving from Ukraine.

NEXT STEPS

The period of consideration of the application for a temporary residence permit in Denmark lasts from 2 to 4 weeks.

The costs of maintenance and necessary medical services for citizens of Ukraine who receive a certificate in accordance with this Law shall be covered by the Danish Immigration Agency until the responsibility for them is transferred to the local government at the municipal level.

The Danish Immigration Agency decides in which municipality Ukrainian citizens will have to live if they have not previously had another residence permit in Denmark.

When filling out the application, it is possible to indicate special wishes about the place where you are going to live. If given the opportunity, the Danish Immigration Agency can grant such a request.

Denmark (excluding the Autonomous Territories of the Kingdom of Greenland and the Faroe Islands) has 98 municipalities in five regions:

Obtaining a temporary residence permit in Denmark exempts Ukrainian citizens from the requirement to obtain a work permit. However, you cannot start working until you receive your license.

If you have been offered a job by the Danish Immigration Agency during your case, you must send a copy of your employment contract to the agency. This may affect which municipality you will be offered to live in.
