How to make a power of attorney while abroad in 2024?

Ukrainians living abroad may need to take legal action in Ukraine. To avoid coming to Ukraine, citizens can issue a power of attorney to their trusted representatives to act on their behalf. This legal document enables them to dispose of property on behalf of the owner. The question remains: can a power of attorney be issued while staying abroad? Read our material.
Issuance of a power of attorney at the consulate
You can get the document either at the consulate of Ukraine or at a local notary.
To submit documents at the consulate, you must first make an appointment. Remember, there is no fixed timeframe for appointment availability, and you may need to wait for an extended period. However, the wait is usually worthwhile because power of attorney issued by the consular does not need additional certification in Ukraine.
Consider that before going to the institution, you need to draw up a power of attorney and determine which powers you plan to delegate to the authorized person. You will submit this text via digital channels.

Issuance of a power of attorney by a notary
An alternative way to get a power of attorney is by contacting a notary. If a foreign specialist is involved, they can only certify the signature and not the content of the document, as it’s written in Ukrainian. However, a Ukrainian must confirm the legal validity of a document by obtaining an apostille.
An apostille is an official stamp that confirms the origin of a document from a specified source. It certifies the authenticity of the signature and seal of a foreign official. This stamp ensures the legal use of documents issued in Ukraine abroad and vice versa. The apostillation procedure is usually carried out by the Ministry of Justice, but it is recommended to check with specific locations for details.
Another option is to draft the power of attorney in a foreign language, certify it at a local notary and translate the already signed document in Ukraine.
