Procedure for submitting documents and legal requirements

In order to obtain a temporary residence permit on the basis of study, you must first of all be a student of a Ukrainian higher education institution at the time of its issuance.

Documents should be submitted no later than 25 days before the expiration of your visa or visa-free stay.

At the same time, foreigners or stateless persons who have reached the age of 16 or have not reached the age of 16 but have arrived in Ukraine on their own for the purpose of studying must submit application forms in person.

The body that accepts foreign students' documents is the Migration Service of Ukraine. At the time of applying for a residence permit, you must either have a D-13 visa or be a citizen of a country with which Ukraine has a visa-free regime.

What documents are required to obtain a residence permit in Ukraine on the basis of study?

The required documents for obtaining the above-mentioned residence permit include

— a valid passport document of a foreigner (or passport documents - in case a foreigner has simultaneous citizenship (nationality) of several states (multiple citizenship) or a document certifying a stateless person with a type D visa, unless otherwise provided by the legislation and international treaties of Ukraine)

— a document certifying the identity of the legal representative and a document confirming the authority of the person as a legal representative (in case of submission of documents by the legal representative) (the originals of the documents shall be returned upon presentation, copies shall be submitted);

— translation into Ukrainian of a page of a foreigner's passport or stateless person's identity document with personal data, certified in accordance with the procedure established by law;

— a valid health insurance policy for the entire period of validity of the residence permit and a copy thereof;

— a document confirming the payment of the administrative fee or a document on exemption from its payment (the original is returned upon submission, a copy is submitted);

— submission of the relevant state body responsible for the implementation of cultural, educational, scientific, sports, volunteer programs, for participation in which the foreigner or stateless person arrived in Ukraine;

— a document confirming the fact of studying in Ukraine (duly certified copies of the order of the educational institution on enrollment and on the establishment of study periods for foreign students);

— the obligation of the educational institution to notify the SMS of the expulsion of a foreigner or stateless person from such an institution.

Please note! A passport must be issued for 10 years, have at least 2 free pages and be valid for at least a year at the time of entry into Ukraine.

Issuance period and decision on refusal

A residence permit is issued within 15 business days from the date of acceptance of documents from a foreigner or stateless person.

A decision to refuse to issue, exchange and issue a residence permit, or to cancel it, may be appealed by a foreigner or stateless person administratively within thirty calendar days from the date of its notification to the foreigner or stateless person or to a court in accordance with the established procedure.

An appeal against a decision to refuse to issue, exchange or issue a residence permit must be accompanied by documents confirming that there are grounds for its revision and cancellation.
