Insurance payments in case of an accident with an electric scooter: how to get compensation
Electric scooters have long been popular on Ukrainian roads, but there are still no clear traffic rules for their drivers. Every day, in both large and small cities of Ukraine, we can see a huge number of electric scooters on the roads. However, the role of an electric scooter driver in the Ukrainian traffic code is still unclear, which can lead to various road accidents. How to act in the event of an accident with an electric scooter and who will receive compensation under motor third party liability insurance in this case is described in the article below.
An accident with an electric scooter: algorithm of actions of a car driver
Due to the fact that there are no precise traffic rules for electric scooter drivers in Ukraine, questions may often arise as to what a car owner should do if he or she gets into an accident with an electric scooter.
The thing is that the driver of a scooter, according to the current traffic rules of Ukraine, is equated to a cyclist or a pedestrian. That is why in Ukraine there are no grounds for taking out CMTPL insurance for this vehicle. And due to the lack of special lanes for scooters and bicycles in some parts of cities, electric scooter drivers often cause accidents involving other cars.
If a car driver is involved in an accident involving an electric scooter, he or she should follow the following rules:
● Check whether the scooter driver was injured. Assess the damage caused to his or her health and, if necessary, provide first aid and call medical assistance;
● An accident involving a car and an electric scooter does not require a Europrotocol. That is why it is necessary to place emergency signs and call the police for further registration of the accident;
● contact the insurance company. Remember that a motor third party liability insurance policy ( MTPL) is compulsory insurance for a passenger car in Ukraine.
Who will receive compensation in the event of an accident involving a car and an electric scooter?
If the driver of an electric scooter is to blame for an accident, the case will be referred to court. If the fault is confirmed, he or she will be charged an amount that will cover all the damage caused to the car. It is also noted that the e-scooter driver may also be fined.
If the driver of the car is to blame for the accident, his or her insurance will cover all the damage caused to the e-scooter. However, for this to happen, the driver must have a valid CMTPL insurance policy.
