What will happen if you do not pay a fine for late updating of data in the TCC?

Under the new draft law on mobilisation, persons liable for military service must update their data within a specific timeframe. Failure to do so will result in a fine. Find out what consequences are expected for refusal to pay the fines

The new 
law on mobilisation in Ukraine has come into force. This means that persons liable for military service have 60 days to update their data in the territorial recruitment centres. If they do not update their data within this period, they will be charged a fine. However, there are several penalties for non-payment of the fine. We'll tell you.


What happens if you do not pay the fine?


In this case, the information about the offender will be transferred to the executive service and the data about him or her will be entered into the Unified Register of Debtors. This, in turn, entails seizure of property and blocking of bank cards.


The law states that only the amount equivalent to the fine can be blocked and withdrawn from the account, but no more. If there are not enough funds, the accounts are blocked until the required amount is accumulated.

What if there was never any money on the card?


In the absence of funds on bank accounts or income to pay the fine, property may be used to cover the fine. However, the property penalty in no case applies to the following items:


- Clothing, footwear, baby gear, crockery, bed linen, hygiene products.

- Medicines, glasses and other medical devices.

- Furniture (there should be one table and wardrobe per family, one bed and chair for each person).

- One refrigerator for the whole family.

- One TV and computer per family, one telephone for each person.

- A supply of drinking water and food.

- Property for religious cults and rituals, professional occupations, if they are the only source of income, tools for personal handicraft and artisanal labour, books.

- Fuel for cooking and heating.

- Seeds for sowing, unharvested crops, agricultural equipment for people engaged in individual agriculture.

- Auxiliary means of rehabilitation.

- Prizes, state awards, honours and commemorative signs.


Other methods


In this case, the police or employees of the TCC can also apply administrative detention if it is necessary to identify the person or find out the circumstances of the violation. The detention may last up to three days.


In addition, if a person liable for military service fails to pay a fine for late data updates, he or she may be issued a second fine, the amount of which will increase to UAH 25,000 for individuals.


In case of non-payment of the second fine, such a person may be held criminally liable for violating the law on mobilisation. Evasion of mobilisation during martial law is punishable by 3 to 5 years in prison.
