On July 16, the deadline for men and women liable for military service to update their military registration data expired. If a person fails to comply with the requirement, a fine will be imposed on such a citizen under the new law on mobilization. How to find out about the open proceedings and what will happen if you do not pay the fine is described in the article below.

What penalties and fines do those who have not updated their data face?


First of all, those who have not updated their military registration data may be subject to penalties, namely a temporary restriction on the right to use vehicles. In addition, failure to update data is subject to a fine. The amount of the fine is set out in Article 210 of the Code of Ukraine on Administrative Offenses.

A fine of UAH 17,000 is provided for the first time for committing an administrative offense, and UAH 25,500 for repeated offenses within a year. For officials and legal entities, it ranges from UAH 34,000 to UAH 59,000.

At the same time, the right to draw up administrative protocols on violations and make decisions on bringing a person to justice is vested in the Territorial Recruitment and Social Support Centers (TSC).

However, according to the Ministry of Defense, fines will not be issued automatically. In accordance with the Code of Ukraine on Administrative Offenses, a fine is imposed within three months from the date of detection of the offense, but not more than one year from the date of commission of such an offense.

How and where can I check whether a fine has been imposed by the TCS?


First of all, remember that fines can be issued in absentia, without the need to draw up a report at the TCS in the presence of a person liable for military service. There are several ways to check whether a fine or enforcement proceedings have been imposed on a person:
1. Through the Diia service (you can find out if there is a fine), but only if the person has not paid it on time. That is, the person will receive a notice of non-payment.

2. Through the Opendatabot service (you can check the fine and open enforcement proceedings). This function is paid and costs 99 hryvnias.
3. Through the register of debtors (you can check only the existence of enforcement proceedings for a fine from the TCC). To do this, you need to generate a corresponding certificate on the absence or presence of open enforcement proceedings, indicating your name and identification code.

What happens if you do not pay the fine?


In this case, the information about the violator will be transferred to the executive service and the data about him/her will be entered into the Unified Register of Debtors. This, in turn, entails seizure of property and blocking of bank cards.

The law states that only the amount equivalent to the fine can be blocked and withdrawn from the account, but no more. If there are not enough funds, the accounts are blocked until the required amount is accumulated.

It should be borne in mind that, according to the law on mobilization, failure to update military registration data after paying a fine is also a violation of military registration. And for violation of the military registration procedure, a person, depending on his or her status, may be held criminally liable under Article 336 or 337 of the Criminal Code of Ukraine. These articles provide for imprisonment or correctional labor.


What if there was never any money on the card?


In the absence of funds on bank accounts or income to pay the fine, property may be used to cover the fine. However, the property penalty in no case applies to the following items:


– Clothing, footwear, baby gear, crockery, bed linen, hygiene products.

– Medicines, glasses and other medical devices.

– Furniture (there should be one table and wardrobe per family, one bed and chair for each person).

– One refrigerator for the whole family.

– One TV and computer per family, one telephone for each person.

– A supply of drinking water and food.

– Property for religious cults and rituals, professional occupations, if they are the only source of income, tools for personal handicraft and artisanal labour, books.

– Fuel for cooking and heating.

– Seeds for sowing, unharvested crops, agricultural equipment for people engaged in individual agriculture.

– Auxiliary means of rehabilitation.

– Prizes, state awards, honours and commemorative signs.
