Before registering a company, a foreigner needs to prepare a business plan and draft a charter for the future activities of the company in accordance with Ukrainian law. It is also necessary to determine the name of the company (it must be unique and not repeat the names in the Unified Register of Legal Entities), type of activity and taxation group.

Does a foreigner need to come to Ukraine to start a business?

A foreigner's physical presence in Ukraine is not required to start a business. This process can be carried out through a power of attorney issued to a lawyer. If a foreigner is abroad, he or she can issue a power of attorney at the Ukrainian embassy and then send it to lawyers who will start working in Ukraine. This includes work on obtaining a work permit, which is then sent to the client to obtain a D-04 visa at the consulate.

If a foreigner is in Ukraine and wishes to apply for a temporary residence permit, he or she must obtain a work permit, then leave the country, obtain a D visa at the embassy on the basis of the issued permit and return to Ukraine for further registration of a temporary residence permit.

Validity of a residence permit

The validity of a residence permit based on business depends on the validity of the work permit. The Employment Center, taking into account the purpose of the foreigner's stay in Ukraine and the importance of the key grounds, may issue it for a period of six months to three years. It should be noted that the permit can be extended if necessary.
