Recently, MP Inna Svystun reported that the Ministry of Justice and the Ministry of Defence supported the draft law on civil partnerships. According to the MP, the Ministry of Justice is already working on amendments to the draft for the second reading. However, it is noted that in order to make a decision, the Verkhovna Rada must support this initiative in the first reading. Read more about what is known today in the article. 


Draft law on civil partnerships: details


What is civil partnership and how does it differ from marriage?


A civil partnership (registered partnership) is a form of recognition of a relationship between people who want to have certain obligations and rights similar to those of people in a formal marriage.


Therefore, a civil partnership is not a formal marriage, but is a voluntary union of two people of the same or different sexes based on respect, understanding, support and mutual rights and obligations. 


The Ministry of Justice reports that the adoption of the draft law on civil partnerships will help Ukraine fulfil its obligations under Article 8 of the ECHR (European Convention on Human Rights). The adoption of the draft law will eliminate the grounds for lawsuits to the European Court of Human Rights for discrimination.

"In general, the Ministry of Justice believes that this draft law is the first progressive step towards a dialogue with society. The goal of the project is to create a legal mechanism for the protection of human rights and freedoms," the MP said. 


The draft law on civil partnerships was registered in the Verkhovna Rada back in March 2023. At that time, the project received support from the first committee of the Verkhovna Rada. It is an alternative solution for Ukrainian couples who, for whatever reason, cannot or do not want to get married. 


However, at that time, the Ministry of Defence did not support the draft law, arguing that by adopting this decision, civil partnerships would be equated with legal marriage, which contradicts Article 51 of the Constitution of Ukraine.
