Leaving Ukraine in 2024: what are the reasons why women may be refused to cross the border?

Under martial law, Ukrainian women can safely travel abroad. However, in some cases they may be refused to do so. Find out what are the most common reasons for refusal to travel abroad for Ukrainian women

In Ukraine, not all men can travel abroad during martial law, but women are allowed to leave the country at any time. However, there are situations when even women are denied permission to leave. With reference to the Legal Adviser to Internally Displaced Persons (IDPs), we will tell you about the most common reasons for refusing to allow Ukrainian women to travel abroad.


It is worth noting that the reasons for refusal to travel abroad can be different. The most common one is the lack of an identity document.


Now that Ukraine is at war, there are also rules that prohibit women with military service obligations from travelling abroad if they do not have a document confirming their deferment. However, this rule is not actually enforced at the border, as the country provides for women to serve in the army only if they wish to do so.

What other reasons could there be?


The issue of travelling abroad by Ukrainians is regulated by the Law "On the Procedure for Departure from and Entry into Ukraine by Citizens of Ukraine". And according to Article 6 of this law, Ukrainian women may be denied permission to travel abroad if:


▪️ They are under administrative supervision of the National Police - until the supervision is terminated.


▪️ They have been informed of information constituting a state secret - until the restrictions expire (notified in each case separately).


▪️ They have been subject to a preventive measure in accordance with the procedure provided for by the criminal procedural legislation, under which they are prohibited from travelling abroad - until the end of criminal proceedings or the cancellation of the relevant restrictions.

▪️ Convicted of a criminal offence - until the sentence is served or the sentence is lifted.


▪️ A woman is the head of a legal entity or permanent establishment of a non-resident that does not fulfil its tax obligations and has a tax debt exceeding UAH 1 million, and such debt has not been paid within 240 calendar days from the date of delivery of the tax demand - until the tax debt is repaid.


▪️ Have an administrative penalty for an offence under Part 7 of Article 184 of the Code of Administrative Offences, which provides for a temporary restriction on leaving Ukraine with a child for a period of 1 year from the date of imposition of the administrative penalty, unless there is a notarised consent to the child's departure from the other parent.


▪️ Evade fulfilment of obligations imposed on them by a court decision or a decision of other bodies (officials), which is subject to enforcement in accordance with the procedure established by law - until the obligations are fulfilled or the child support arrears are paid.


Can I not be allowed to travel abroad because of debts?


Having a loan debt does not in itself prevent you from travelling abroad, unless there is a court decision to temporarily restrict the debtor's right to travel. However, if enforcement proceedings are initiated, this may be grounds for a travel ban. In the case of debts and evasion of obligations, the enforcement officer has the right to initiate a court procedure to temporarily restrict the right of the debtor, whether an individual or a director of a legal entity, to travel outside Ukraine until the debt is repaid.


In the case of child support arrears exceeding the total amount of payments for four months (or three months in some cases), the state enforcement officer has the right to impose a temporary restriction on the debtor's right to travel outside Ukraine.
