How to unilaterally resign from your job: instructions for IDPs

Many Ukrainians had to change their place of residence and move to a safer area because of the war. Some citizens did not have the opportunity to resign from their jobs in person, and it was impossible to continue working at their previous place of residence due to the hostilities. Read more about how to apply for unilateral dismissal in this article. 


Unilateral dismissal for IDPs: what is known 


Recently, the Ombudsman Dmytro Lubinets announced that from now on, IDPs have the right to apply for unilateral dismissal. To do this, it is enough to submit a relevant application to the Employment Centre at the place of current residence addressed to the former employer. In this case, the date of termination of the employment agreement will be the day following the submission of the application. 


In turn, the Employment Centre, to which the application was submitted, will notify the following authorities of the termination of the employment contract:


  • The employer to whom the application was submitted. It is noted that if the case concerns an employer who, at the time of submission of the application, is located in the occupied territory and it is not possible to contact him/her, the application will be kept in the territorial body of the central executive authority until the territory is de-occupied. After the liberation of the territory, the Employment Centre will notify the employer of the termination of the employment contract within 7 calendar days;
  • territorial body of the Pension Fund of Ukraine; 
  • the territorial body of the State Tax Service.

It is also noted that if an IDP does not have the documents required to obtain unemployment status, the status is granted under a simplified procedure without additional requirements. However, until the necessary documents and information on employment history, income, etc. are received, the person can only rely on the minimum unemployment benefit.
