Receiving an inheritance in Ukraine for non-residents: details

Foreign citizens have the full right to inherit property in Ukraine. The basic principles of inheritance are unified for both residents and non-residents. At the same time, there are a number of important nuances that require special attention.

In order to successfully complete the inheritance procedure, it is recommended to:

- thoroughly check all documents;

- consult with specialised lawyers;

- be prepared for possible additional procedures;

- have patience and endurance.

Requirements for foreigners to receive an inheritance in Ukraine

Since foreign heirs often do not have the physical ability to be present in Ukraine, the law provides for a mechanism of remote representation. For this purpose, a special power of attorney is executed, which must meet a number of strict requirements.

Such a power of attorney must be absolutely legitimate and include the widest possible range of powers: from re-registration of property rights to payment of taxes and other necessary legal actions. It is crucial that the document undergoes a full legalisation procedure - notarisation, apostillisation or legalisation, depending on the country of origin.

Another prerequisite is to obtain an identification code in Ukraine. This is mandatory even if the heir has no previous ties to the country. This document is critical for further legal procedures.

The next key point is taxation. Regardless of the degree of kinship, a foreign heir pays the taxes required by law. The only exceptions are residents with a permanent residence permit in Ukraine.

Documents required for inheritance in Ukraine

The inheritance process requires careful preparation of documentation. A number of important documents must be collected and properly executed. The key documents include:

- a notarised application for inheritance;

- a copy of the passport and identification code with an apostille;

- death certificate of the testator;

- documents confirming kinship;

- original of the will (if any).

Particular attention should be paid to the legalisation and notarisation of documents. If the documents are issued abroad, they need to be apostilled or legalised.

Terms and conditions for a foreigner to receive an inheritance in Ukraine

The general term for inheritance is 6 months from the date of the testator's death. This period is unified for both Ukrainian citizens and foreigners.

If the deadline is missed, it may be renewed through a court procedure. For this purpose, it is necessary to provide strong arguments and evidence explaining the reason for the delay.

It is also worth paying attention to some specific restrictions. In particular, agricultural land plots must be sold within one year of receiving the inheritance.
