The issue of obtaining a living allowance for internally displaced persons (IDPs) after returning from abroad is an important aspect of social support in Ukraine. According to the current legislation, the procedure and conditions for granting payments depend on the IDP status, previous receipt of assistance and other criteria.


Let's look at how this issue is regulated for those who have previously received assistance.


Key provisions of the Procedure for Providing Assistance to IDPs


According to the Procedure for Providing Accommodation Assistance to IDPs approved by the Government of Ukraine, persons who apply for assistance for the first time after returning from abroad may receive payments provided they meet the property criteria and submit an application no earlier than 15 business days after their return.


However, the situation is more complicated for those who have previously received assistance but have traveled abroad and have now returned. Can such persons count on continuation of payments?


Rights of persons who have previously received assistance


In accordance with clause 13 of the Procedure, the persons entitled to continue payments include:


- Recipients of assistance under the Procedure or those who were entitled to payments from August 1, 2023 in accordance with the Resolution of the Cabinet of Ministers No. 709.

- Persons who have moved from the territories of active hostilities or temporary occupation.

- Persons whose housing has been destroyed or damaged to the point of being uninhabitable.

- Persons who previously received assistance but refused it or had their payments terminated.

- Persons deregistered as IDPs who have returned to their place of previous residence and re-registered.


Thus, if IDPs previously received assistance and their payments were terminated due to traveling abroad, they can expect to continue receiving assistance if they meet the criteria of paragraphs 13-1 to 13-4.


The explanation of the Ministry of Social Policy dated 01.10.2024 states that such persons are entitled to continue their assistance. At the same time:


- They are not subject to the restrictions of clause 8 of the Procedure, which provides for the cancellation of payments for traveling abroad for more than 30 days.

- In order to continue payments, it is necessary to meet individual criteria (e.g., being a person with a disability, a pension recipient, a pregnant woman, etc.) or criteria for family payments.


It is also important to take into account the requirements of paragraphs 7 and 7-1 of the Procedure regarding the verification of property status.

1. Upon returning to Ukraine, apply to the social protection authority to renew your IDP registration.

2. Check your compliance with the criteria stipulated in paragraphs 13-1 to 13-4 and prepare the necessary documents.

3. If you have any questions, consult a lawyer or representatives of local administrative service centers.
