Bali attracts the attention of many investors, but buying real estate on this tropical island has its own peculiarities. It is important to understand that the rules familiar to the European market do not apply here, and legal nuances can lead to serious financial losses.
In this article, Visit Ukraine lawyers explain the main nuances of buying real estate in Bali.
The main myth: “I am buying real estate”
For foreigners, buying real estate in Bali does not mean obtaining ownership of the land. According to Indonesian law, ownership rights (Hak Milik) are not available to foreigners. Instead, other mechanisms are used:
Leasehold (Hak Sewa): a long-term lease for 25-30 years with the possibility of renewal.
HGB (Hak Guna Bangunan): the right to build and use through a local company.
PT PMA: an Indonesian company with foreign capital that meets all requirements.
It is important that the agreement is legally sound. Foreigners often sign contracts without considering their goals and may not get what they expect.

A development agreement ≠ a secure agreement
An agreement with a developer in Bali is not a standard of security. It often serves to protect the interests of the seller, not the buyer.
The main risks include:
No penalties for missed deadlines.
Possibility of changes in planning without approval.
Unclear land status and zoning.
Sale of properties without a full set of documents.
Signing such a contract does not guarantee the legality of the property.

Guaranteed income — the most dangerous trigger
The phrase “guaranteed income” should raise alarm bells. Income from real estate depends on various factors, such as the legality of short-term leases, zoning type, and licensing. Without these aspects, any potential income may be nothing more than a marketing slogan.
Legal support is not “document verification”
In Bali, legal support is risk management, not a formal check. Effective support includes:
Due diligence of land and construction.
Verification of the legal chain of ownership.
Analysis of zoning and permitting documentation.
Adaptation of contracts to the buyer's interests.
Without proper support, the buyer risks getting into legal trouble.
Why are there no universal solutions?
Each property can be a successful investment for one person and a legal trap for another.
It depends on many factors, including citizenship, tax status, and purchase objectives.
Buying real estate in Bali is not just about a good price, but about the right legal structure of the deal. If it is structured incorrectly, even the most beautiful villa will not save your investment. Expert support at all stages of the deal is the key to success in your investment strategy.
