In which cases veterans and servicemen may not take out a motor third party liability insurance policy for their cars: details

In Ukraine, compulsory motor third party liability insurance is a prerequisite for the legal use of a vehicle. However, for veterans and some other categories of military personnel, the law provides for special benefits that exempt them from the need to take out a motor vehicle liability insurance policy under certain circumstances. As a general rule, all vehicle owners in Ukraine are required to take out a policy of compulsory civil liability insurance (CTP), or “motor third party liability insurance”. It covers the costs of an accident if another driver or pedestrian is injured.


However, certain categories of veterans and military personnel have an exception to this rule, which is set out in the Law of Ukraine “On Compulsory Insurance of Civil Liability of Owners of Land Vehicles” (Article 13).


Who is eligible for benefits under the CTPCI?


The lawyers of the Ukrainian Veterans Fund remind that the following categories of citizens can do without obtaining an MTPL policy:


• Combatants, including those who took part in hostilities in eastern Ukraine or other conflicts.

• Injured participants of the Revolution of Dignity who were injured during the events of 2013-2014.

• Persons with disabilities as a result of war are veterans who sustained a disability during military operations.

• Persons with disabilities of group I who drive their own cars.

• Persons who drive a car owned by a person with a group I disability, but only if the owner of the car is in the vehicle while driving.

Conditions and limitations of the benefit


In order to receive the benefit, a veteran or a person with a disability needs to have a certificate confirming the relevant status, as well as documents proving the right to own or use a car (a purchase and sale agreement, lease agreement or other documents).


However, there is an important limitation: this benefit is personalized. In other words, the right not to take out a motor vehicle liability insurance policy is valid only if the beneficiary drives the vehicle himself.


If the car belongs to a veteran but is driven by a family member or other person who does not have the status of a combatant or a disability, such a driver is obliged to take out a motor vehicle liability insurance policy. Otherwise, if stopped by the patrol police, such a person faces a fine, and in the event of an accident, compensation for damages to the victims at their own expense.


What should I do if a veteran's family uses his or her car?


If a veteran's car is used, for example, by his wife or other family members, they need to take out a motor vehicle liability insurance policy. The benefit is valid only for the veteran or other beneficiary, provided that he or she personally drives the vehicle, so for other persons, even close relatives, a motor vehicle liability insurance policy is mandatory.

The amount of compensation in the event of an accident is limited: the insurer will pay the victim no more than UAH 130,000 for car repairs, or no more than UAH 260,000 if the driver's health was damaged.
