Men permanently residing abroad are obliged to come to the TCS and re-register: details

Previously, men who left Ukraine for permanent residence were deregistered from the military register. However, now this provision of the law is no longer in force and such persons must come to the TCS and re-register. On May 18, a new law on mobilization came into force, including updated rules on military registration for persons (men and women liable for military service) abroad. On May 16, the Cabinet of Ministers adopted a resolution regulating the procedure. From now on, the rules of military registration for men and women liable for military service abroad are the same as those applicable to such persons in Ukraine.

Deregistration when traveling abroad: what has changed?


According to the old rules, when leaving Ukraine for permanent residence for more than 3 months, conscripts, persons liable for military service and reservists had to personally apply to the military registration and enlistment office with documents confirming their departure abroad in order to be deregistered. 


However, this provision is no longer in the law. This means that under the new rules, such persons are not removed (excluded) from military registration when traveling abroad. And those citizens who have previously undergone this procedure and are not currently registered are obliged to register for military service within 30 days from the date of entry into force of the Cabinet of Ministers' Resolution No. 563 of May 16, 2024, by personally coming to the district (city) military registration and enlistment offices, the Security Service of Ukraine, or the relevant units of the intelligence agencies of their choice.


Thus, it is necessary to come to Ukraine and fulfill the requirement by June 16, 2024.

What else will change for men temporarily or permanently residing abroad?


As noted by the Judicial and Legal Newspaper, the new Cabinet of Ministers resolution provides for a number of other changes. In particular, they relate to foreign diplomatic missions of Ukraine. Thus, embassies, consulates and other representative offices will be checked for compliance with the requirements set out in paragraphs 2 and 3 of clause 52 of the Procedure for Organizing and Maintaining Military Registration of Conscripts, Persons Liable for Military Service and Reservists, approved by the Cabinet of Ministers of Ukraine on December 30, 2022, No. 1487, informing and submitting notifications to the relevant district (city) TCCs about the registration or deregistration of conscripts, persons liable for military service and reservists.


Thus, foreign diplomatic missions will be checked for fulfillment of the following obligations:


1. Informing conscripts aged 18 to 25 who are registered with the consular authorities on a permanent or temporary basis.

2. During a special period, informing persons liable for military service and reservists who do not have a deferral from military service during mobilization for a special period, and facilitating their return to Ukraine.

3. Notification of permanent or temporary consular registration or deregistration of conscripts, persons liable for military service and reservists to the relevant district (city) TCC, the SSU, the relevant units of intelligence agencies at the place of their military registration according to the list by means of the system of electronic interaction of state electronic information resources (before the introduction of such electronic interaction, notification is carried out within 7 days from the date of permanent or temporary consular registration or deregistration to the
