Deferment for fathers with many children: men will have to bring an additional document to the military commissariat

Ukrainian men who have three or more children are, according to the law, exempted from mobilisation into the army. However, in order to receive a deferment they need to provide documents confirming the status of having many children. As it turned out, the list of such documents has expanded. The government has adopted Resolution No. 560, which approves the algorithm of actions for persons liable for military service, including fathers with many children. Now, they will have to prove notarially that they are actually involved in the maintenance of their children. We will tell you what exactly this means with reference to Glavсom.


MP Ihor Fris explains the situation with the new resolution: "A person liable for military service and a father of three minor children has been declared fit for military service. According to the mobilisation law, he should automatically receive a deferral from mobilisation. His children are born to two women from whom the man is divorced, he is not living, but continues to financially support the children."


According to him, the resolution additionally requires an agreement between the man and his former spouse stating that he will contribute to the maintenance of his minor children.


The resolution actually mentions a written agreement between the parents, which should specify with whom the children will live and the participation of the other parent in their upbringing.

Initial rules for parents with many children


According to Article 23(1)(4) of the Law of Ukraine "On Military Mobilisation Preparation and Mobilisation", men who have three or more dependent children under the age of 18 are not subject to call-up for military service during mobilisation. Accordingly, a father with many children cannot be taken to the front, and he has the right to leave Ukraine freely.


Under current law, a man with three or more children from different marriages is no exception. Thus, relying on paragraph 26 of the "Rules for Crossing the Border", such a man can leave Ukraine. But at the same time, the key factor is not paternity, but rather the maintenance of minor children.
