Citizenship by birth and by descent

Citizenship obtained as a result of marriage
A foreigner who has come to live in Azerbaijan and entered into a marriage with a citizen of the country may apply for citizenship. The legislation does not specify the timeframe after which the right to apply for a passport through marriage is granted. In most cases, the application is approved after 5 years of official marriage.
Citizenship by naturalization
A foreigner can initiate this procedure after 5 years of continuous residence in the country
The application will be approved if a number of conditions are met
- compliance with the laws of the country
- language proficiency
- availability of officially confirmed monthly income
- availability of a permanent residence permit
When is dual citizenship possible?
Officially, the government does not approve of having a second passport and requires renunciation of citizenship of another country when issuing a citizenship permit.
However, a newly minted Azerbaijani can keep his passport and his second citizenship. On the territory of Azerbaijan, he will be subject only to local laws.
This creates an ambiguous situation:
- the authorities do not approve of second citizenship
- no one officially prevents the retention of a second passport
Ukrainians who have been legally residing in the territory of the Republic of Azerbaijan for the last five years, have a legal source of income, have undertaken to comply with the Constitution and laws of the Republic of Azerbaijan, and have provided relevant documents proving their knowledge of the state language of the Republic of Azerbaijan, regardless of their race, nationality, gender, education, religion, political or other views, may be admitted to the citizenship of the Republic of Azerbaijan.
The period of permanent residence in the territory of the Republic of Azerbaijan of a foreign citizen or stateless person is calculated from the date of receipt of a permanent residence permit in accordance with the procedure established by law.
Foreign citizens and stateless persons apply to the State Migration Service of the Republic of Azerbaijan for the acquisition of Azerbaijani citizenship.
Acquisition of Azerbaijani citizenship
A person wishing to acquire the citizenship of the Republic of Azerbaijan shall apply to the State Migration Service of the Republic of Azerbaijan with an application form addressed to the President of the Republic of Azerbaijan, the sample of which is approved by the President of the Republic of Azerbaijan.
- Application form (must be typed on a computer) - printed in 2 copies;
- Application addressed to the President of the Republic of Azerbaijan (to be typed on a computer) - printed in 2 copies;
- Autobiography (to be typed on a computer) - printed in 2 copies;
- Photograph (3x4 cm in size) - 4 pieces;
- Receipt of payment of the state fee (200 manats);
- Certificate from the Ministry of Education on knowledge of the state language of the Republic of Azerbaijan;
- A copy of the passport or other document for crossing the border (except for those who do not have these documents, persons who have been granted refugee status, as well as persons in respect of whom the court has established the fact of lack of citizenship of any state, as well as permanent residence in the Republic of Azerbaijan) - (attach a notarized translation);
- A document confirming the existence of a legal source of income (one of the following documents: a certificate from the place of work (indicating salary), a certificate of receipt of a pension, allowance or targeted state social assistance, a tax authority's certificate of income, a certificate of alimony, a certificate of income of a person under whose care the person is, a certificate of inheritance, etc.); If the person is not working, a citizen of the Republic of Azerbaijan may undertake the obligation.
In this case:
- A statement of commitment by the person assuming the obligation (notarized);
- Identity card of the person assuming the obligation (notarized);
- A document confirming the legal source of income of the person making the commitment (certificate of employment, pension, scholarship, etc.);
- A copy of the court decision establishing the fact that the person does not have citizenship of any state, as well as permanent residence in the Republic of Azerbaijan in accordance with part four of Article 14 of the Law of the Republic of Azerbaijan “On Citizenship of the Republic of Azerbaijan”;
- For persons who have high achievements in the field of science, technology, culture or sports, as provided for in paragraph 1 of part 4 of Article 14 of the Law of the Republic of Azerbaijan “On Citizenship of the Republic of Azerbaijan”, a substantiated request from the state body that invited the person to the Republic of Azerbaijan.
- Copies of the identity cards of close relatives who are citizens of the Republic of Azerbaijan (if any).
In case of submitting an application for citizenship of the Republic of Azerbaijan together with their minor children, the following documents must be attached:
- A statement of consent from the second parent (notarized);
- A copy of the passport of the other parent (notarized);
- A copy of the marriage certificate;
- Declaration of consent of children aged 14-18 (notarized).
Note: The application form and the application must also contain the names of the minor children of the applicant, as well as 4 photographs (3x4 cm in size).
