Temporary residence permit in Azerbaijan

Ukrainians must obtain a temporary residence permit in the territory of the Republic of Azerbaijan. This permit is issued by the State Migration Service of the Republic of Azerbaijan. When these persons are allowed to reside in the country, the State Migration Service issues a temporary residence permit.

A temporary residence permit in the territory of the Republic of Azerbaijan is a document that gives the right to temporarily reside in the country, leave the Republic of Azerbaijan and return to it without a visa during the validity period, as well as the identification of these persons in the country and their registration at the place of residence.

Cases of issuing a temporary residence permit to Ukrainians in the territory of the Republic of Azerbaijan are listed in Article 45 of the Migration Code:

being in close family relations with a citizen of the Republic of Azerbaijan;
investment in the country's economy in the amount of at least 500,000 manats;
ownership of real estate in the territory of the Republic of Azerbaijan worth at least AZN 100,000;
investing funds in the amount of not less than AZN 100,000 on the basis of a term deposit agreement with banks operating in the territory of the Republic of Azerbaijan;
Obtaining a work permit to carry out paid labor activity in the territory of the Republic of Azerbaijan in accordance with the procedure established by this Code;
receive education in higher and secondary specialized educational institutions on a full-time basis and in general educational institutions;
to engage in professional religious activity in religious structures that have passed state registration;
when recognizing a person as a victim of human trafficking;
to assist criminal prosecution authorities, etc.

Permanent residence permit in Azerbaijan for Ukrainian citizens

A Ukrainian who has a temporary residence permit in Azerbaijan can apply for a permanent residence permit. To do this, it is enough to reside in the country continuously for two years. Continuous residence is defined as residence during which a foreigner does not leave the country for at least 90 out of 180 days.

The procedure for applying for a permanent residence permit is similar to the procedure for obtaining a temporary residence permit. However, such an application can be submitted no later than 3 months before the expiration of the temporary residence permit.

What documents are required for issuing (extending) a temporary residence permit in Azerbaijan?

An application, a sample of which is approved by the relevant executive authority;
A passport or other border crossing document (the validity of the passport or other border crossing document must be at least three months longer than the validity of the temporary residence permit);
A notarized copy of the birth certificate or other document that replaces it (for persons under 18 years of age and without a passport);
A document confirming the existence of circumstances in a notarized procedure or a procedure equivalent to it, which is the basis for issuing a temporary residence permit;
A certificate stating that he/she is not a carrier of a disease virus provided for in the list of dangerous infectious diseases approved by the relevant executive authority;
A copy of the document granting the right to temporary residence or temporary stay in the territory of the Republic of Azerbaijan;
A substantiated request from an enterprise, institution or organization inviting Ukrainians who are highly qualified specialists in the economic, industrial, military, scientific, cultural, sports and other fields to the Republic of Azerbaijan;
Two 3.5 x 4.4 cm photographs;
A document for the residential premises in which he/she will be registered (an extract from the state real estate register on the state registration of ownership, a warrant, a lease agreement or other document provided for by the legislation of the Republic of Azerbaijan);
Application of the person providing the accommodation (except in cases when the foreigner has his/her own living space);
A copy of the identity document of the person providing the accommodation (except in cases where the foreigner has his/her own accommodation);
Document on payment of the state fee.

When issuing a temporary residence permit, Ukrainians are also issued a document on the payment of the state fee.

A temporary residence permit for foreigners and stateless persons may be issued for a period not exceeding one year and may be extended in appropriate cases for a period not exceeding 2 years.

Citizenship obtained as a result of marriage

A foreigner who has come to live in Azerbaijan and entered into a marriage with a citizen of the country may apply for citizenship. The legislation does not specify the timeframe after which the right to apply for a passport through marriage is granted. In most cases, the application is approved after 5 years of official marriage.

A foreigner can initiate this procedure after 5 years of continuous residence in the country

When is dual citizenship possible?

Officially, the government does not approve of having a second passport and requires renunciation of citizenship of another country when issuing a citizenship permit.

However, a newly minted Azerbaijani can keep his passport and his second citizenship. On the territory of Azerbaijan, he will be subject only to local laws.

This creates an ambiguous situation:

the authorities do not approve of second citizenship
no one officially prevents the retention of a second passport

Ukrainians who have been legally residing in the territory of the Republic of Azerbaijan for the last five years, have a legal source of income, have undertaken to comply with the Constitution and laws of the Republic of Azerbaijan, and have provided relevant documents proving their knowledge of the state language of the Republic of Azerbaijan, regardless of their race, nationality, gender, education, religion, political or other views, may be admitted to the citizenship of the Republic of Azerbaijan.

The period of permanent residence in the territory of the Republic of Azerbaijan of a foreign citizen or stateless person is calculated from the date of receipt of a permanent residence permit in accordance with the procedure established by law.

Foreign citizens and stateless persons apply to the State Migration Service of the Republic of Azerbaijan for the acquisition of Azerbaijani citizenship.

Acquisition of Azerbaijani citizenship

A person wishing to acquire the citizenship of the Republic of Azerbaijan shall apply to the State Migration Service of the Republic of Azerbaijan with an application form addressed to the President of the Republic of Azerbaijan, the sample of which is approved by the President of the Republic of Azerbaijan.

Application form (must be typed on a computer) - printed in 2 copies;
Application addressed to the President of the Republic of Azerbaijan (to be typed on a computer) - printed in 2 copies;
Autobiography (to be typed on a computer) - printed in 2 copies;
Photograph (3x4 cm in size) - 4 pieces;
Receipt of payment of the state fee (200 manats);
Certificate from the Ministry of Education on knowledge of the state language of the Republic of Azerbaijan;
A copy of the passport or other document for crossing the border (except for those who do not have these documents, persons who have been granted refugee status, as well as persons in respect of whom the court has established the fact of lack of citizenship of any state, as well as permanent residence in the Republic of Azerbaijan) - (attach a notarized translation);
A document confirming the existence of a legal source of income (one of the following documents: a certificate from the place of work (indicating salary), a certificate of receipt of a pension, allowance or targeted state social assistance, a tax authority's certificate of income, a certificate of alimony, a certificate of income of a person under whose care the person is, a certificate of inheritance, etc.); If the person is not working, a citizen of the Republic of Azerbaijan may undertake the obligation.

In this case:

A statement of commitment by the person assuming the obligation (notarized);
Identity card of the person assuming the obligation (notarized);
A document confirming the legal source of income of the person making the commitment (certificate of employment, pension, scholarship, etc.);
A copy of the court decision establishing the fact that the person does not have citizenship of any state, as well as permanent residence in the Republic of Azerbaijan in accordance with part four of Article 14 of the Law of the Republic of Azerbaijan “On Citizenship of the Republic of Azerbaijan”;
For persons who have high achievements in the field of science, technology, culture or sports, as provided for in paragraph 1 of part 4 of Article 14 of the Law of the Republic of Azerbaijan “On Citizenship of the Republic of Azerbaijan”, a substantiated request from the state body that invited the person to the Republic of Azerbaijan.
Copies of the identity cards of close relatives who are citizens of the Republic of Azerbaijan (if any).

In case of submitting an application for citizenship of the Republic of Azerbaijan together with their minor children, the following documents must be attached:

A statement of consent from the second parent (notarized);
A copy of the passport of the other parent (notarized);
A copy of the marriage certificate;
Declaration of consent of children aged 14-18 (notarized).

Note: The application form and the application must also contain the names of the minor children of the applicant, as well as 4 photographs (3x4 cm in size).
