INTRODUCTION


Please read these terms and conditions carefully before using this Site.

If you do not agree to these terms and conditions, do not use this Site.

Use of this Site, including filling out various forms and applications, as well as ordering goods/services through this Site, constitutes your acceptance of the terms of this Agreement.

The User confirms that they have read all the provisions of this Agreement and unconditionally accept them.

Users have the right to view and download information and materials from the Site solely for personal (non-commercial) use, provided that they fully comply with intellectual property laws and other requirements of the current legislation of Ukraine.

Commercial and/or public use of materials, information, and other data posted on the Site is prohibited.

Any use of the Site’s materials, information, or other data on other websites without the copyright holder’s consent is prohibited.


DEFINITIONS


The terms used in this Agreement have the following meanings:


Site — the website www.visitukraine.today.

Administration — VISIT UKRAINE LLC, located in Kyiv at 8/9 Khrestovyi Lane, Office 19, e-mail: [email protected], EDRPOU code 44587839 (hereinafter: “Administrator”).

User — a person who views information on the Website and/or orders and/or receives goods/services using the Website’s tools.

Agreement — this agreement and the terms of use for the website www.visitukraine.today.


COMPLIANCE WITH REQUIREMENTS


The User is personally responsible for safeguarding their login, password, and other registration data used to access the Website.

The User is prohibited from disclosing their login, password, or other registration data to third parties.

In the event of loss of the login, password, or other registration data, the User agrees to follow the instructions provided on the Site for their recovery.

If it is impossible to recover the registration data in accordance with the instructions, the User must contact the administration.


RIGHTS AND OBLIGATIONS OF THE ADMINISTRATION AND SITE MODERATORS


The Administration has the right to change the site’s design and content at any time and without notice.

The Administration is entitled to contact users by phone, email, and other means of communication regarding the use of the Site.

The Site moderator, appointed by the Administration, monitors and takes necessary measures to ensure that content posted on the Site is relevant to the Site’s subject matter.

The moderator and the Site Administration make every effort to remove from the Site any information that is negligent, inaccurate, offensive, untrue, or knowingly incomplete.

The information on the Site is constantly updated and may become outdated at any time.

The Site Administration is not liable for the receipt of outdated information from the Site, nor for the User’s inability to receive updates to the information stored on the Site.

The Site Administration may use users’ personal data to communicate with these users, for example, to notify them of changes/updates to the Site’s services or to send important messages and other similar communications regarding products ordered by the user, and to contact them for purposes related to user/customer service, as well as to inform them about promotions, discounts, and exclusive offers on the Site.


LIMITATION OF LIABILITY OF THE ADMINISTRATION


The Site Administration makes reasonable efforts to ensure the uninterrupted operation of the Site, as well as the accuracy and timeliness of the information posted; however, it does not guarantee that the Site will function continuously, without errors, delays, or technical failures.

The information, materials, and services of the Site are provided “as is.” The Administration makes no express or implied warranties regarding the completeness, accuracy, timeliness, fitness for a particular purpose, or error-free nature of the information posted on the Site.

The Administration is not liable for:

● any direct, indirect, incidental, special, or consequential damages arising from the use or inability to use the Site;

● the actions of third parties, including partners, payment systems, insurance companies, carriers, government agencies, or other entities whose services may be offered through the Site;

● errors, inaccuracies, or outdated information obtained from public sources or third parties;

● unauthorized access to user accounts, if such access became possible due to the user’s failure to comply with security requirements;

● temporary suspension of the Website’s operation, technical malfunctions, data loss, or disruptions in the operation of communication networks or software.

In any case, the Administration’s aggregate liability to the User shall not exceed the amount actually paid by the User for the relevant service that is the subject of the dispute, unless otherwise provided by mandatory provisions of Ukrainian law.


USER RIGHTS AND OBLIGATIONS


The User has the right to use the information and functionality of the portal and to contact the Site Administration to resolve any disputes.

The Site Administration does not guarantee that all user requests will be processed.

The User agrees to take appropriate measures to ensure the security of their personal login and password for accessing the Site.

The User agrees to bear full responsibility for any actions taken using their account, as well as for any consequences that may result from or have resulted from such use.

By using information from the Site, the user acknowledges and accepts the risks associated with its potential inaccuracy, as well as the fact that some information may seem offensive, misleading, rude, or indecent to them.

The user agrees to publish any information from the Site with a mandatory link to the portal https://visitukraine.today.

At the same time, every user whose personal data is concerned has the right:

1) to access their personal data,

2) to correct their personal data,

3) to request the deletion of their personal data,

4) to request the restriction of the processing of their personal data,

5) to object to the processing of their personal data,

6) to file a complaint with the supervisory authority.

Withdrawal of consent or objection to the processing of personal data is carried out by sending an email to the Administrator’s email address: [email protected]

Once the User has withdrawn their consent or expressed their objection, the User’s personal data will no longer be processed for the purposes for which it was provided. The User may change or supplement their personal data by sending a request to the Administrator’s email address: [email protected]

In the event of any violations related to the Administrator’s processing of data, the User has the right to file a complaint with the President of the Personal Data Protection Authority.

TERMS FOR PLACING AN ORDER


Through the service, the Client is provided with the opportunity to review pricing offers for services based on the data entered by the Client, compare service costs, and select service options.

When filling out the fields, the Client is obligated to provide accurate and up-to-date information to create a Client profile, including a unique email address for each Client.

The Customer is responsible for the accuracy, timeliness, and completeness of the information provided when filling out the form fields, as well as for its compliance with Ukrainian law and the non-infringement of third-party rights.

The Site Administration assumes no obligation to verify or modify the information entered by the Customer when filling out the form/order fields.

It is the Customer’s responsibility to provide current and accurate information.

If the Customer orders a service and does not pay for it within the specified time limit, such an order will be automatically canceled by the service provider.

Payment for the order is made via cashless payment on the Website using the WayForPay payment service, the Portmone payment service, the ApplePay payment service, the GooglePay payment service, or Visa and MasterCard cards (from any bank in Ukraine).

The Customer independently selects a payment method from among those offered.

The Customer bears full and sole responsibility for all commission fees and other charges imposed by the bank, which may be added to the cost of the bank card issuer.

The Customer consents to the processing of their personal payment data.

After the Customer proceeds to the field for entering payment card details, responsibility for providing the services lies with the payment system or the acquiring bank.

The payment information for the bank card provided by the Customer is entered on a secure online acquiring page and is not transmitted to the Website https://visitukraine.today.


REFUND POLICY


Refunds to customers are processed by refunding the cost of the product purchased on the Website via a transfer to the bank card used for payment.

The timing and amount of the refund depend on the insurance company and are processed within the timeframe established by Ukrainian law.

Commissions and acquiring fees charged by the bank, payment systems, and bank card service providers are not refundable.

The procedure for refunding funds to Customers is carried out in accordance with the Agreements concluded with the Company’s partners.


TERMS OF PUBLICATION AND USE OF MATERIALS POSTED BY THE ADMINISTRATION OR USERS


The publication of materials on the Site submitted by users is permitted only if the information provided is relevant to the Site’s subject matter and terms.

The Administration reserves the right to delete comments without providing reasons for such deletion or if the User’s materials do not comply with the terms of publication and use.

User content is published with the author’s name clearly indicated.

Each author bears full responsibility for the information submitted for publication on the Site.

It is prohibited to post offensive, rude, or threatening comments, use profanity, or pressure or influence other users in any other way.

A User who leaves such comments will be blocked by the Site Administration.

A User who has submitted information for publication on the Site is obligated to comply with the provisions of current Ukrainian legislation.

The use and copying of materials posted on the Site is permitted only provided that a link to the Site is included.

Articles on the Site may be copied only with the prior consent of the Site Administration.


DISPUTE RESOLUTION AND GOVERNING LAW


These Terms and all legal relationships between the User and the Administration are governed by the laws of Ukraine.

The parties agree to attempt to resolve any disputes, disagreements, or claims arising from the use of the Site or the performance of these Terms through negotiation and out-of-court settlement.

The User has the right to submit a written claim to the address or email address specified on the Site. The Administration shall review such a claim and provide a response within 30 (thirty) calendar days from the date of its receipt.

If no agreement is reached through negotiations, the dispute shall be subject to review by a competent court of Ukraine in accordance with the rules of venue and jurisdiction established by the current legislation of Ukraine.

If certain services are provided by foreign partners or governed by separate agreements, special dispute resolution rules provided for in such agreements or by law may apply to the relevant legal relationships.


AGE RESTRICTIONS


The Site is intended for use by individuals who are at least 18 years of age and have full legal capacity under the laws of their country of citizenship or residence.

Individuals under the age of 18 may use the Site only with the consent and under the supervision of their parents, adoptive parents, guardians, or other legal representatives.

By using the Site, the User confirms that they have reached the required age or have the proper permission from a legal representative to use the Site and fully understand the content and consequences of accepting these Terms.

The Administration has the right to request confirmation of the User’s age in cases where this is necessary to provide certain services or comply with legal requirements.
