Ukrainian refugees who arrived in Germany after the start of the full-scale invasion of russia in February 2022 will be able to retain the right to receive the status of late migrants. According to DW, citing a statement by Juliane Seifert, a representative of the German Ministry of the Interior, this right will be enshrined in a German government decree.

What is the status of a late migrant?


Late immigrant status in Germany is a special legal mechanism that gives descendants of ethnic Germans from the former Soviet Union the right to repatriate to Germany. This status provides more stable legal grounds for staying in the country for a long period of time.

The status of a latecomer also provides access to a wide range of social services, including health care, education, and employment, which is an important aspect for Ukrainians seeking to build a life in Germany.

What will change for Ukrainian refugees in Germany?


Thanks to a new German government decree, Ukrainians with German roots whose repatriation application was previously rejected due to the war will now be able to resume the process of confirming their status as latecomers. This change will apply retroactively from the beginning of the war. Thus, refugees who were previously unable to obtain this status due to forced flight from Ukraine will now have the opportunity to re-apply and confirm their right to repatriation.

How to obtain the status of a late migrant?


The process of obtaining late migrant status includes submitting documents confirming ethnic German origin, as well as the need to prove that the applicant or his or her ancestors lived in the territory of the former Soviet Union. Applicants must meet certain criteria, including knowledge of the German language and adherence to German culture.

Signs of belonging to the group of late immigrants may include, in particular

– good knowledge of the German language

– German surname;

– German parents (origin);

– belonging to the German minority in Ukraine;

– family ties with German citizens in Germany;

– membership in a German minority organization.

In addition, family members (children, grandchildren, great-grandchildren) and spouses can also obtain the relevant status, provided that the marriage has lasted at least 3 years.

Currently, the issue of obtaining the status of a late migrant in Germany is regulated by the Refugee and Exile Act (BVFG), the General Administrative Regulation to the Refugee and Exile Act, the Citizenship Act (StAG) and the Law on Predecessors.
