Ukraine has changed the conditions for granting maternity leave to military personnel

Ukrainian legislation has finalized changes to the conditions for granting paternity leave to men. Now, more attention is paid not only to the categories of persons entitled to this leave, but also to the procedure for processing the necessary documents to obtain it. Learn more about the changes

The Cabinet of Ministers of Ukraine, by its Resolution No. 356 dated 29.03.2024, amended the Procedure for Granting Parental Leave. The amendments do not concern the categories of persons entitled to this leave, but the documents required for its registration. 


Thus, the list of required documents confirming the right to childbirth leave and the conditions under which certain categories of persons are entitled to the said leave have been clarified.


Updated conditions for granting maternity leave 


The right to leave remains with the following persons:


▪️ the husband of the woman who gave birth to the child,

▪️ the actual father of the child, regardless of the marriage status with the mother (however, both parties must live together, run a common household and have mutual rights and obligations)

▪️ grandparents or other adult relatives of the child who are actually involved in the child's care if the father or mother is a single parent.


However, now, the child's father must provide the following documents to confirm his right to leave:


▪️ The child's birth certificate, which indicates him as the father,

▪️ A written statement from the mother confirming cohabitation, common household and mutual rights and obligations with this man.


Similarly, adult relatives of a child raised by a single father or mother need to submit a corresponding application.


The relevant changes have been introduced to expand the range of persons who can take advantage of maternity leave and to ensure greater convenience and transparency in the process of applying for leave.

Maternity leave in Ukraine


As you know, Ukrainian law provides for the right of every pregnant woman to maternity leave and related payments during pregnancy and after childbirth. The duration of this leave is 126 days, of which 70 calendar days are before childbirth and 56 days are after. In the case of complicated childbirth or the birth of two or more children, the duration of postpartum leave is increased to 70 days, for a total of 140 calendar days.


Women who fall into categories 1-3 of persons affected by the Chornobyl disaster are entitled to 180 days of leave, of which 90 days are before childbirth and 90 days are after.


According to the calculations, the minimum amount of maternity benefits per month cannot be less than the minimum wage, and the maximum amount cannot exceed the "maximum amount of the unified social tax base." For unemployed women, the payments are equal to 25% of the monthly subsistence minimum for an able-bodied person.
