Real estate prices in Ukraine: how much will it cost to buy an apartment in 2024?
Extract from the State Register of Real Property Rights and real estate inspection
Requesting an extract from the State Register of Real Property Rights is the first step in the process of further processing documents for the purchase of an apartment. The document will tell you who the owner is and whether there are any encumbrances/restrictions. Only after obtaining this document can you sign a preliminary agreement or an advance/deposit agreement (optional) with a notary.
However, it is important to understand that this is only a basic check available to the buyer to determine whether the property is worthy of attention. Since it is the notary's job to register the transaction, he or she should only make sure that it is possible to do so, but no more. The notary will not check the court register, the validity of title documents, or the relevance of the technical passport. Fraudsters are well aware of the limits of notarial verification and successfully use them. Therefore, in order to avoid buying a problematic property, you should contact a lawyer who will check the seller and the property in detail.
What documents does a buyer need to buy an apartment?
The list of documents that a buyer will need to purchase an apartment includes:
— Passport of a citizen of Ukraine or ID card (for a minor - birth certificate + consent of the board of trustees of the local government to purchase real estate by a minor), if the buyer is a foreigner, then another document proving his identity is provided;
— Registration number of the taxpayer's registration card (identification code);
— Marriage certificate or divorce certificate (if any);
— Written consent of the spouse (if married). It can be made by any notary, but usually by the one who will certify the sale and purchase agreement. However, if both spouses are involved in the transaction, this document may not be required.

What documents should the seller of an apartment have?
The seller is also required to prepare a package of documents. What the seller-owner must provide:
— Original title documents;
— Extract from the Register of Real Property Rights;
— Passport, identification code;
— Written consent of the spouse, if there is a marriage;
— Marriage certificate or divorce certificate (if there is a marriage);
— Technical passport for the apartment issued by the BTI or a relevant licensed entity;
— Permission of the guardianship and custody authorities - if there is a minor who will act as a buyer (or become a co-owner);
— A real estate appraisal report;
— A co-owner's waiver of the priority right to purchase a share of the apartment - if a part of the real estate is being sold;
— A certificate of no utility payment arrears;
— Power of attorney from the owner(s), if the seller is an authorized representative.
Please note! The family composition certificate has been canceled in accordance with the order of the Ministry of Social Policy of July 17, 2019 No. 1106.
The documents collected by the seller must be checked by a notary and a lawyer. If the documents are in order, you can proceed to the conclusion and signing of the purchase and sale agreement with a notary.
