The culprit fled the scene of an accident: how to get compensation under CTP insurance?
It is not uncommon for unscrupulous drivers who have created an emergency situation on the road that has led to an accident to flee the scene. Find out more about what to do if the culprit has left the scene of an accident and how to get insurance compensation in this case
As a rule, obtaining compensation under a compulsory motor third party liability insurance policy in the event of an accident with a clearly identified victim and culprit is straightforward.
You can read more about how to get compensation under a motor third partyliability policy here.
However, the situation is quite different when the culprit of the accident has left the scene. The article explains whether it is possible to receive monetary compensation for damages in this case and where to apply.
What to do if the culprit fled the scene of an accident?
According to the laws of Ukraine, there are two options in the event of an accident: drawing up a Europrotocol (if the situation allows) and calling the police.
You can find out more about the conditions for drawing up the Europrotocol in Ukraine here.
However, what should you do if the person responsible for the accident fled the scene?
● Do not move the car, switch on the hazard warning light and put up an emergency sign;
● Call the police;
● Try to find witnesses to the accident or find out if there are any surveillance cameras on the road. Also, if possible, take photos and videos of the scene;
● notify the insurance company of the situation.
Upon arrival at the scene of the accident, the police will draw up a report. You should read it carefully.
In order to find the fleeing culprit, you need to contact the police and write a statement, providing a copy of the protocol and a video recorder, if available.

How can I get compensation for damages after an accident if the culprit has fled?
Keep in mind that only those drivers who have a valid compulsory motor third party liability insurance policy can count on compensation for damages in the event of an accident.

A motor third party liability insurance policy (MTPL) is a guarantee of compensation for damages in the event of an accident. On the Visit Ukraine portal, you can buy a CTP insurance policy from a licensed insurer. Packages with a deductible of UAH 3200, UAH 1600 and UAH 0 are available.
If the culprit has left the scene of the accident without permission, the injured driver must contact the Motor Transport (Insurance) Bureau in person within 3 days of the accident with a package of the following documents to receive compensation:
● application for insurance indemnity;
● insurance policy of MTPL;
● passport of a citizen of Ukraine
● registration number of the taxpayer's account card (TIN);
● technical passport for the car;
● bank details;
● a report from the scene of a road traffic accident.
The Motor Transport (Insurance) Bureau will make a decision on the reimbursement within 90 days after the application is submitted. Keep in mind that it is prohibited to repair the damaged car until then.
Just a reminder. For every vehicle with a Ukrainian registration, it is mandatory to take out a motor third party liability insurance policy. Find out what penalties are provided for by law for not having a policy and how to buy CTPCI online here.
