Temporary residence permit in Ukraine: how to apply?

A temporary residence permit in Ukraine is an official document that grants a foreigner or stateless person the right to temporarily reside in Ukraine on a legal basis. This document is issued in accordance with the Law of Ukraine “On the Legal Status of Foreigners and Stateless Persons” dated 22.09.2011 No. 3773-VI (hereinafter - Law No. 3773-VI), and is also regulated by bylaws.

Who can get a temporary residence permit?
According to Article 4 of Law No. 3773-VI, a temporary residence permit in Ukraine can be obtained by foreigners and stateless persons who:
1. Arrived in Ukraine for the purpose of employment (if they have a work permit).
2. Carry out activities related to participation in international projects, volunteer work, or research.
3. Arrived to study at accredited educational institutions.
4. Are family members of Ukrainian citizens or have close relatives with a permanent residence permit.
5. Arrived to participate in the activities of religious organizations.
6. Exercise the right to family reunification (in cases provided for by law).
7. Employees of representative offices of foreign companies or investors.

Procedure for obtaining a temporary residence permit for foreigners in Ukraine
1. Preparation of documents
According to the Resolution of the Cabinet of Ministers of Ukraine No. 322 dated 25.04.2018, in order to obtain a residence permit, an applicant must submit to the territorial unit of the State Migration Service of Ukraine (SMS)
● an application;
● a valid passport document with a translation into Ukrainian
● a document confirming the grounds for staying in Ukraine (employment contract, certificate of study, marriage documents, etc.);
● receipt of payment of the administrative fee;
● photographs of the prescribed form.
2. Submission of the application and documents
The application is submitted in person to the SMS unit. It is important to remember that a foreigner has the right to apply for a residence permit within 15 working days from the date of obtaining a residence permit or the grounds for obtaining a residence permit.
3. Consideration of documents
The term for reviewing documents is up to 15 working days. During the inspection, the SMS authorities may request additional information or confirmation.
4. Obtaining a residence permit
After the decision is approved, the applicant receives a residence permit for a period that depends on the grounds (for example, for the period of validity of the work or study permit).
How to extend a temporary residence permit in Ukraine?
To extend the validity of a temporary residence permit, you must apply to the SMS no later than 15 working days before the expiration of the permit. The procedure is similar to the initial registration, but requires additional confirmation of the extension of the grounds for stay (extension of the contract, certificate from the place of study, etc.)
What else should a foreigner know about obtaining a residence permit
1. Registration of the place of residence
After obtaining a temporary residence permit, a foreigner is obliged to register his or her place of residence within 30 calendar days (Article 6 of Law No. 3773-VI). We described in detail how to obtain registration or declare the place of residence in our previous article.
2. Administrative liability
