The Polish Senate has approved amendments to the draft law on the employment of foreigners. The innovations relate to the conditions of employment, the process of obtaining permits, and control over employers. According to inpoland.net.pl, this decision should simplify bureaucratic procedures, eliminate abuses and promote the electronicization of processes.


What is the purpose of the reform?


These amendments are part of a large-scale reform of the Polish Ministry of Family, Labor and Social Policy. They are intended to:


● Reduce the number of unresolved cases in the departments

● limit abuses by employers

● introduce full electronization of the work permit issuance process

● increase the efficiency of state employment services.


Key changes in the employment of foreigners in Poland


The Senate adopted two key amendments to the law:


1. Empowerment of employment agencies. From now on, they will be able to employ foreigners not only under employment contracts (uchastia o pracovanii), but also under civil law agreements.

2. Criminal record check. In order to obtain a work permit, a foreigner must provide information about his or her criminal record. This innovation is aimed at strengthening control and security.


New restrictions on the employment of foreigners


Among other things, the draft law provides for additional changes that may significantly affect foreign workers:


1. List of prohibited professions. Starostas will have the right to determine the professions and types of work for which work permits will not be issued to foreigners in a particular region.

2. Abolition of labor market analysis. Previously, before hiring a foreigner, it was checked whether there was a local employee for the vacancy. Now this procedure has been canceled.

Electronicization and control over employers


To make the process more transparent and convenient:


● Support points for foreigners will be set up at county labor offices.

● Voivodes will have the right to refuse work permits to companies that operate mainly for paperwork rather than real economic activity.

● The entire process of issuing permits will become electronic - from submitting an application to receiving a decision.


What does this mean for foreign workers?


The amendments to the law should simplify the process of obtaining permits, but at the same time increase control over employers and employment conditions. This will help those who really intend to work legally in Poland and will complicate the schemes of illegal employment.
