Anti-Semitism in Ukraine will be punished very severely: offenders face up to 8 years in prison

Ukraine has officially established criminal liability for any manifestations of anti-Semitism. Law No. 2037-IX, signed by President Volodymyr Zelenskyy, poses a significant obstacle to the incitement of interethnic hostility. Now, such offenses are punishable not only by heavy fines but also by actual prison terms, demonstrating the state’s zero tolerance for any form of discrimination.
The Law on Anti-Semitism in Ukraine: The Essence of the Changes
The relevant bill (No. 5110) was overwhelmingly supported by the Verkhovna Rada, receiving the votes of 295 members of parliament. The main goal of the document is to clearly define the legal framework and ensure reliable protection for citizens against manifestations of hatred on ethnic or religious grounds. For a long time, such offenses could be classified under general provisions on hooliganism; however, the law now emphasizes the inevitability of punishment specifically for crimes motivated by intolerance.
It is important to note that the law protects not only against physical violence but also against verbal insults, calls for discrimination, or the destruction of property on the grounds of anti-Semitism.
Article 161 of the Criminal Code of Ukraine: What Has Changed
The basis for law enforcement is the updated version of Article 161 of the Criminal Code of Ukraine. Historically, this article has regulated issues of violations of citizens’ equality based on their race, nationality, religious beliefs, disability, and other characteristics.
With the adoption of the new law, the text of the article now includes a direct legal definition of antisemitism as a criminally punishable act. This eliminates ambiguity in court interpretations and allows law enforcement agencies to classify hate crimes more quickly and effectively.

What is the punishment for antisemitism in Ukraine?
The law provides for a strict and multi-tiered system of sanctions, which depends on the severity of the crime committed. A warning will no longer suffice.
For basic manifestations of antisemitism, the offender is required to pay a fine ranging from 3,400 to 8,500 hryvnias (from 200 to 500 non-taxable minimum incomes). If the court deems the financial penalty insufficient, the offender faces restriction of liberty for up to five years or imprisonment for up to three years. Additionally, the offender may be barred from holding certain positions for a similar period.
Liability is significantly increased if the offense was accompanied by violence, threats, or fraud, or if the law was violated by an official using their official position. In such cases, the minimum fine increases to 17,000 hryvnias, and the term of actual imprisonment will be from two to five years.
The harshest punishment is reserved for organized criminal groups, as well as for individuals whose actions caused serious harm to the health or lives of the victims. For such criminals, the law is uncompromising: they face five to eight years of imprisonment.
