According to the latest data, women in Europe earn about 11% less on average than men, and the pension gap reaches about 25%. The new directive is designed to change this situation systematically – through transparency, control and responsibility of employers.

Why is there a need for new EU wage rules?
Despite many years of equality policies, the pay gap remains stable. One of the key reasons, experts say, is the lack of transparency: employees often do not know how much their colleagues earn for similar work.
This creates conditions for hidden discrimination - often even unconscious. The problem has especially worsened after the COVID-19 pandemic, when women more often took on additional care responsibilities, which affected their income and career opportunities.
What will change for employees after the approval of the new EU wage directive?
The new directive introduces a number of specific rights that should make the wage system more open and fair.
Transparent vacancies
Employers will be required to indicate the salary or its range at the stage of posting a vacancy or before the interview. Job descriptions should also be gender-neutral.
Ban on asking about past salary
Companies are prohibited from asking candidates about their previous income level. This is important to avoid “carrying over” old discrimination to a new job.
Right to information
Employees will be able to receive data on:
- Average salaries for similar positions (disaggregated by gender);
- Criteria for setting salaries and career growth.
Openness in discussing salaries
Employers will no longer be able to prohibit employees from discussing their pay among themselves.

Compensation for discrimination
If an employee has been discriminated against, he or she has the right to full compensation - including unpaid wages, bonuses and other payments.
Important! Now it is the employer who must prove the absence of discrimination, not the employee - its presence.
New obligations for companies under the Pay Directive
The Directive significantly strengthens the requirements for businesses, especially medium and large ones.
Gender gap reporting
Companies with more than 250 employees will have to report annually.
Companies with 100-249 employees – every three years.
Less than 100 employees – no reporting obligation.
Pay gap monitoring
If the pay gap exceeds 5% and has no objective explanation, the company must conduct a joint pay analysis together with employee representatives and implement corrective measures.
Sanctions
Non-compliance is subject to fines and other sanctions, which must be effective and dissuasive.
New focus: intersectional discrimination
For the first time, the EU level takes into account the so-called intersectional (intersectional) discrimination – situations where a person faces inequality due to a combination of factors (for example, gender and disability or ethnic origin).
The directive also takes into account the needs of people with disabilities, which expands its social impact.
When will the new wage rules come into effect in the EU?
By June 7, 2026, all EU countries must implement the directive into national law, the actual application of which will be:
- From 2027 – for large companies;
- From 2031 – for smaller employers.
Despite calls from businesses to postpone the launch due to the complexity of the implementation, the European Commission confirmed its intention to adhere to the established deadlines.
