Notification and delivery of summonses at work: what does the law say?
The new law No. 3633-IX on strengthening mobilization (draft law 10449) will come into force on May 18. And this law legally enshrines the concept of notification.
Thus, according to the document, notification is the delivery of signals and messages (directives, orders) to military authorities, central and local executive authorities, local governments, enterprises, institutions, organizations and the public about the announcement of mobilization, summoning citizens to the military and civilian contact center, as well as the delivery (sending) of summonses to citizens.
At the same time, Article 21 of the Law "On Mobilization Preparation and Mobilization" stipulates that enterprises, institutions and organizations are obliged to keep military records of conscripts, persons liable for military service and reservists among their employees, take measures to reserve persons liable for military service and report on these issues to the relevant authorities. Employers must also ensure the timely arrival of employees involved in the performance of mobilization duties to assembly points and military units.
However, after the amendment of Article 21 of this law, the obligations of business are added to "ensure timely notification and arrival of employees... to assembly points by taking appropriate information, organizational and technical measures with further compensation of the costs of such process from the State Budget, which is carried out no later than one month after the submission of the relevant application in accordance with the procedure established by the CMU".
Thus, companies will have to provide "notification", and this concept, as already mentioned, includes the delivery of summonses.
We remind you! In Ukraine, amid changes to the mobilization rules, it was decided to significantly increase fines for violations of the same rules. Read our previous article to find out what exactly the penalties will be imposed for and who they may affect.
