Rules and necessary documents for men with disabilities to leave Ukraine in 2024
Men with disabilities of groups I, II, and III have the right to leave Ukraine during martial law, but the list of required documents has been supplemented. Find out what documents are needed to cross the border in 2024 and why a disabled person may not be allowed to travel abroad
According to clause 2 of the Rules for Crossing the State Border, citizens of Ukraine, during the state of emergency or martial law on the territory of Ukraine, persons with disabilities, regardless of their group, have the right to cross the state border. The number of border crossings is not limited, and the grounds for leaving Ukraine may be any reason: treatment, rest, study, work, personal goals, etc.
At the same time, in order for a disabled spouse of groups I, II or III to be allowed to travel abroad, he or she must provide documentary evidence of disability and deregistration from the military.
What documents are required for a disabled man of group I, II or III to leave Ukraine?
1. Foreign passport
2. A document confirming the disability. It can be:
– a certificate confirming the status of a disabled person;
– a pension certificate or a certificate confirming the status of social assistance in accordance with the laws of Ukraine;
– a certificate of receipt of benefits by persons with disabilities who are not entitled to a pension or social assistance, in the form approved by the Ministry of Social Policy.
3. Document confirming the person's removal from the military register
According to the updated information, representatives of the State Border Guard Service also require the following documents when crossing the border:
– A certificate from the MCC (an extract from the MCC protocol on the decision to postpone/remove from military registration, etc;)
– A military registration document with a record of deferment/removal from registration.
Can a disabled spouse be refused to cross the border?
The final decision on whether a person with a disability can travel abroad is made at the checkpoint by representatives of the State Border Guard Service. Thus, in case of inaccuracies in the documents, the need for additional confirmation of the information provided or other circumstances, border guards may refuse to cross the border.
In addition, a person with a disability may not be allowed to leave Ukraine if they
– has a travel ban imposed by a court or other public authority;
– has been suspected or accused of committing a crime that is being investigated or prosecuted.
And also in case of absence of all necessary documents for crossing the border.
The refusal must be made in writing and the grounds must be stated. Thus, a written explanation can be used to appeal the refusal to cross the border by filing a complaint with the head office of the State Border Guard Service or a lawsuit with an administrative court.
