New rules for serving summonses and expanding the powers of the TAC: details of the adopted law on mobilization

Yesterday, on April 11, the Verkhovna Rada of Ukraine finally passed draft law No. 10449 on mobilization with 283 votes in favor. It is now to be signed by Parliament Speaker Ruslan Stefanchuk and President Volodymyr Zelenskyy. The new law will come into force a month after Volodymyr Zelenskyy signs it. So, what changes to the mobilization procedure will come into effect in the near future?


Updating data within 60 days: who is affected and how to do it?


According to the new rules, after the law comes into force, all persons liable for military service must update their personal data (phone numbers, email addresses, place of residence, etc.) within 60 days. This can be done by visiting an ASC, a territorial acquisition centers (TAC), or remotely through the conscript's electronic cabinet.


It is important to note that the draft law excluded the provisions on "calls in the phone" and mandatory registration of the e-cabinet. Therefore, the decision to use the e-cabinet will be made at the discretion of each individual.


It should be noted that all persons liable for military service, including those currently abroad, will have to update their credentials. At the same time, citizens permanently residing abroad will need to re-register for military service in Ukraine. The Cabinet of Ministers will determine how they should do this.

Also, according to the new rules, representatives of military registration and enlistment offices will be able to check military registration documents on a par with police officers. All Ukrainians liable for military service must always carry such documents (military registration certificate, military ID card or temporary certificate of a person liable for military service).

Temporary ban on the right to drive a vehicle


The new rules provide for a change in the procedure for bringing to justice those who fail to appear at the TAC with a summons. It should be noted that a valid reason for failure to appear may be a natural disaster, illness or death of a close relative. If a person fails to arrive at the TAC on time, he or she must explain the reason within three days.


If the person liable for military service does not appear at the appointed time, representatives of military registration and enlistment offices will be able to file an appeal to the police for administrative detention of the evaders. If the person is not found, the TAC will send a registered letter to the person liable for military service with a corresponding request. The person will be given 10 days to arrive at the territorial center. If the request is ignored, the TAC will apply to the court for a temporary ban on driving. Such a ban will remain in effect until the request is fulfilled or withdrawn.


At the same time, such restrictions will not apply to persons whose work is directly related to cars and transportation, as well as those who use cars due to disability (or have a child with a disability or a person with a disability of group I or II).
