Car towing in Ukraine: inspectors will be banned from sending cars to the impound lot during the war

The Ukrainian parliament says that parking inspectors are significantly abusing decisions to evacuate cars in large cities. Therefore, they want to take away such powers from them during martial law. Find out who will be able to send cars to the impound lot now
The Verkhovna Rada has approved draft law 9092-3, which provides for a ban on car towing by parking inspectors. This measure is planned to be introduced only for the duration of martial law. However, this does not mean that there will be no evacuations at all. We explain.
The changes will only affect the powers of parking inspectors to ensure road safety. However, the decision to evacuate will be made by officers of the National Police of Ukraine.
As the authors of the draft law point out, "the provisions of the draft law support the initiative to grant the relevant powers to authorised persons of the National Police."
At the same time, inspectors will be able to continue to consider cases of administrative offences and issue decisions on bringing to administrative responsibility. Thus, municipal inspectors will be able to issue fines for parking for people with disabilities.
We would like to note that the draft law has not yet been adopted as a basis, but if this happens, the following amendments will be made to the Code of Administrative Offences
- a ban on the temporary detention of a vehicle by parking inspectors only during the legal regime of martial law;
- expanding the list of grounds for parking inspectors to bring to administrative liability under part 6 of Article 122 (stopping or parking of vehicles in places marked with appropriate road signs or road markings, where only vehicles driven by drivers with disabilities or drivers transporting persons with disabilities are allowed to stop or park) and part 6 of Article 152-1 (Parking of a vehicle in places intended for free parking of vehicles driven by persons with disabilities) and Part 6 of Article 152-1 (Parking of a vehicle in places intended for free parking of vehicles driven by a driver with a disability).
- clarifies the sanctioning rules of Articles 122 (Exceeding the established speed limits, driving through a prohibitive traffic control signal and violation of other traffic rules) and 152-1 (Violation of the rules of parking of vehicles and violation of the rules for the equipment of paid parking areas).

Why do they want to deprive inspectors of the right to detain cars?
Simply put, the legislators argue that today, in most cases, the executive committees of local councils abuse this right and turn the evacuation of vehicles into their own business project.
Often, such detentions take place even without legal grounds. The situation is particularly shameful in large cities: Kyiv, Kharkiv, Dnipro, Odesa, etc. At the same time, the pricing of vehicle evacuation services is non-transparent and usually overstated. Private companies or individual entrepreneurs close to the city's leadership are directly involved in vehicle evacuation.
The draft law should also regulate the issue of temporary detention of vehicles, especially during air raids, which will help to save the lives and health of drivers who are forced to quickly leave their vehicles to seek shelter, violating the rules of stopping or parking.
