Cars with debts, seizures, or other encumbrances are increasingly being sold through electronic auctions. Such vehicles may belong to debtors in enforcement proceedings, be subject to collateral, or be the property of companies in liquidation. After purchasing a car, the new owner must undergo a mandatory re-registration procedure at the Ministry of Internal Affairs service center.

Selling a car with encumbrances: what the buyer needs to know


Electronic auctions allow you to purchase a car at a price below market value, but such purchases are associated with additional risks. This primarily concerns the legal status of the vehicle — seizures, pledges, prohibitions on alienation, or being on the wanted list.


That is why, after the auction is completed and the purchase and sale agreement is concluded, the new owner cannot immediately use the car legally without re-registering it.

Key conditions for re-registering a car at an MIA service center


The main requirement for re-registering a car purchased at auction is the complete removal of all restrictions and encumbrances at the time of application to the MIA service center.


These include:

● seizures within the framework of enforcement proceedings;

● prohibitions on alienation;

● declaring the vehicle wanted;

● records of pledges or other restrictions in state registers.


If at least one of these restrictions remains in force, the MIA service center will refuse to re-register the vehicle, even if you have a complete set of documents confirming the legal purchase of the vehicle at auction.


Who should remove the encumbrance from the vehicle


The removal of restrictions is the responsibility not of the buyer, but of the authority or person who sold the property. Depending on the situation, this may be:

● a state or private executor;

● the liquidator of the enterprise;

● another authorized person within the scope of the sale procedure.


Only after the official changes have been made to the state registers is the car considered “clean” from a legal point of view.

To avoid being denied re-registration, before visiting the Ministry of Internal Affairs service center, you should:

● carefully check all documents received after purchasing the car at auction;

● make sure that all arrests and restrictions have been lifted;

● if necessary, independently check the information about the vehicle in the state registers.
