Ukrainian legislation provides for two different mechanisms for prohibiting the driving of vehicles: restrictions and deprivation of driving privileges. They differ in terms of grounds, procedure for application, and consequences for the driver. The Main Service Center of the Ministry of Internal Affairs reminds drivers of two separate legal mechanisms that prohibit driving vehicles. Despite their external similarity, restrictions on the right to drive and deprivation of the right to drive have different legal nature, different grounds for application, and different consequences for the driver.


What exactly are the differences between these two mechanisms, who applies them, and what is the liability for violating the ban? We will explain this further in this article.

What is a restriction on the right to drive a vehicle?


A restriction on the right to drive is a measure of enforcement of decisions applied by state or private enforcement agents within the framework of enforcement proceedings. The mechanism is provided for by the Law of Ukraine “On Enforcement Proceedings” and is used to encourage the debtor to fulfill their financial or other legal obligations. The key point is that such a restriction is in no way related to a violation of traffic rules.


A typical example is a situation involving alimony arrears. The state enforcement officer opens enforcement proceedings and issues a decision on the temporary restriction of the debtor's right to drive vehicles. This ban remains in force until the debt is fully repaid. It is important to note that the driver's license remains with the owner — it is not physically confiscated. Information about the restriction is entered into state registries, and it is on the basis of this data that violations are recorded in the event of driving during the period of the ban.

What does deprivation of the right to drive a car mean?


Disqualification from driving is a type of administrative penalty that is applied exclusively by court decision. The basis for such a penalty is a violation of road safety legislation. That is, we are talking specifically about situations related to the driver's behavior on the road, and not to his financial obligations or other civil law relations.


A common situation is when a driver gets behind the wheel while intoxicated. The court finds him guilty and decides to revoke his driving privileges for a specified period, for example, one year. After the period of revocation ends, the driver's license is returned in accordance with the procedure established by law. At the same time, in certain cases specified by law, the driver may need to retake a theoretical or practical exam to restore their driving privileges.

The main differences between restricting and revoking driving privileges


The main difference between the two mechanisms is in the grounds and the entities that apply them. The restriction is imposed by the executor within the framework of enforcement proceedings, and the grounds are the debtor's failure to fulfill their obligations (for example, non-payment of alimony). Revocation, on the other hand, is imposed exclusively by a court for traffic violations.


The consequences for the driver also differ significantly. In the case of a restriction, the driver's license remains in the driver's possession, and after the obligations are fulfilled, the ban is automatically lifted — without the need to take exams or obtain a new document. In the case of deprivation, the license is confiscated and is only returned after the expiration of the period determined by the court and may require retaking exams. One thing remains the same: driving a vehicle while any of these prohibitions are in effect is an offense punishable under the Code of Ukraine on Administrative Offenses.

Liability for driving a car while a ban is in effect


Regardless of the type of ban in effect — restriction or deprivation — it is prohibited to get behind the wheel during this period. Violation of this requirement entails administrative liability under road safety legislation.


The Code of Ukraine on Administrative Offenses regulates the prosecution of drivers who drive vehicles while a ban is in effect.

Drivers should remember that information about restrictions and revocation of driving privileges is recorded in the relevant state registries. Therefore, the fact of a violation can be detected during any roadside check. Knowing the difference between these two mechanisms will help you better understand your rights and obligations.
