The European Union has launched a new round of discussions regarding the future of temporary protection for Ukrainians. As reported by Radio Free Europe’s “How Are You?” project, officials in Brussels are considering options for reforming the current system, including a possible restriction on the categories of people eligible for protection.


Specifically, this involves potential changes that could affect men of draft age and take into account the applicants’ region of origin.


Why is the EU reviewing its decision on temporary protection?


In June 2025, the European Commission proposed not to extend temporary protection beyond March 2027 and to transition Ukrainians to national residence permits—based on work, study, or other grounds.


EU countries endorsed this recommendation in September. The idea was to avoid a situation where over 4 million Ukrainians would simultaneously lose their legal status and place a burden on the asylum system.


However, practice has shown that the transition to other types of permits is proceeding very slowly due to high income requirements, more complex bureaucratic procedures, and the lack of clear mechanisms in many countries. That is why the EU has returned to discussing this issue.


What changes are being discussed in the European Union?


The European Commission is preparing a new proposal, which it plans to present in May. The final decision must be adopted by member states by a qualified majority vote. Among the options being considered:

● extending temporary protection, but to a limited group of people;

● taking into account the region of origin of Ukrainians;

● a separate approach for men of conscription age;

● creating a “residual status” for the most vulnerable groups.


European Commissioner for Home Affairs and Migration Magnus Brunner noted that “temporary protection is temporary,” and the EU needs a plan for after 2027.

Could entry be restricted for men of conscription age?


One of the most controversial issues is the possibility of restrictions for men aged 18 to 60. This idea has already been partially implemented by some countries:

● Norway restricted access to protection for men in this category in 2026;

● Switzerland began taking the region of origin into account, recognizing parts of western Ukraine as “safe”;

● Denmark has also considered similar restrictions.


At the same time, lawyers warn that such decisions could be challenged.


According to immigration lawyer Yulia Zelvenska:

● there is a risk of discrimination;

● the right to refuse military service applies in the EU;

● any restrictions must be proportionate and justified.


Will the changes affect all Ukrainians?


Discussions are currently in the early stages, so no final decisions have been made. At the same time, according to diplomats, there is a possibility that the new rules will apply to new arrivals, while Ukrainians who already have temporary protection will be able to retain their status.


One of the EU’s key goals is to prevent the collapse of the asylum system if millions of people simultaneously begin submitting new applications after the directive expires.


Can Ukrainians obtain permanent status in the EU?


Despite a long stay in Europe, Ukrainians with temporary protection currently do not have an automatic chance at long-term status. As experts explain:

● temporary protection does not count toward the residency period required to obtain permanent documents;

● the relevant EU directive does not apply to this category of individuals;

● neither EU countries nor Ukraine supported the idea of changing this rule.


What does this mean for Ukrainians abroad?


The situation remains uncertain: the EU may either extend the current protection mechanism or significantly alter it. Therefore, Ukrainians should monitor official decisions, assess the possibility of switching to other types of permits, and prepare documents in advance.
