According to Ukrainian law, every driver of a vehicle must take out compulsory motor insurance. Motor third party liability insurance (MTPL) is a Ukrainian insurance policy that compensates victims of road traffic accidents. MTPL insurance is valid only in Ukraine, so it will not cover losses abroad. It is worth reminding you that to travel abroad, you must have a Green Card policy. How insurance works in the event of a road accident with victims and guilty parties, as well as with third parties, is described further in the article.
Compensation algorithm: who receives compensation under CMTPL insurance in case of an accident if the culprit is clearly identified?
Is insurance paid to the person responsible for an accident? The answer is obvious: no. If both parties to a road traffic accident have a compulsory motor third party liability insurance policy, the culprit's insurance company will compensate the injured party for the losses. However, it should be borne in mind that the amount of compensation in the event of an accident is limited: the insurer will pay the victim no more than UAH 160,000 for car repairs, or no more than UAH 320,000 if the driver's health was damaged. If this amount is not enough to compensate for the damage caused, the person responsible for the accident will have to cover the rest on their own.
Mutual fault in an accident: how does motor third party liability insurance work if both drivers are to blame for an accident?
Road traffic accidents often occur on the road where both drivers are considered to be at fault and victims at the same time. In this case, the effect of the motor third party liability insurance is not cancelled. However, the Law "On Compulsory Insurance of Civil Liability of Owners of Motor Vehicles" stipulates that in such a case, the insurance indemnity for damages in the event of an accident will be divided in half between both drivers.
If you find yourself in such a situation, remember:
● call the police immediately. Keep in mind that in a situation where there is more than one person responsible for an accident, the European Protocol does not apply;
● the amount of compensation is determined by the insurance company based on the conclusions of an expert assessment;
● independent initiation of repairs prior to the expert assessment may result in the insurer refusing to pay the claim.
Who is deemed to be at fault if there are more than two culprits in an accident?
It is not uncommon for several cars moving in the same direction to collide on the road. Usually, in such situations, the drivers who were driving behind are recognised as the culprits, because they were the ones who failed to react in time to the stop or sudden braking of the car in front. In other words, the driver of the first car that was hit is exempt from liability if he or she did not violate traffic rules. The drivers of the subsequent cars that followed and did not keep a safe distance are liable for the accident. In this case, if you have a valid MTPL policy, the insurance companies of each of the perpetrators will cover the losses of the victims.

Who compensates for losses if the culprit of the accident does not have MTPL insurance?
If the person responsible for the accident does not have insurance, Ukrainian law provides protection for the victims. In such a situation, the Motor (Transport) Insurance Bureau of Ukraine (MTIBU) is responsible for compensating the victims.
However, there is an important condition: MTIBU will only cover losses if the injured party has a valid motor third party liability policy. After the accident, the damaged car must be kept in an unchanged condition until it is inspected by an expert appointed by the MTIBU.
According to the law, the MTIBU compensates the injured party and then collects this amount from the culprit in court. In some cases, the culprit of an accident without a valid insurance policy may agree to voluntarily compensate for the damage. In this case, it is enough to receive the required amount from him/her and issue a receipt of receipt of funds and no claims. It is important to correctly assess the damage caused to avoid underestimating or overestimating the cost of car repairs.
