Germany has prepared an important draft law aimed at supporting Ukrainian citizens seeking temporary asylum in the country. The new document provides for the extension of the Aufenthaltsübergangsverordnung for Ukrainian citizens under temporary protection.

Although the draft law has not yet received final approval, it has already been published on official government platforms and is expected to be adopted in the near future.

We will tell you what you need to know about the document further in the article.

We talked about fines for unemployed refugees and other changes that Ukrainians in Germany will face by the end of 2024 in our previous article.

Key provisions of the draft law

1. Extended entry and application periods: According to the new rules, Ukrainian citizens have the right to enter Germany until December 4, 2025 and apply for temporary protection in accordance with §24 of the Migration Act.

2. Duration of temporary protection: If they apply for temporary protection, they will be able to stay in Germany until March 4, 2026.

3. Possible extension of §24: It is expected that along with this draft law, §24 of the Migration Act, which gives Ukrainians the right to temporary protection in Germany, will be extended.

5. Legal employment: The draft law provides an opportunity to confirm legal residence and work permit, which greatly simplifies the process of job search for Ukrainians and facilitates communication with employers.

asked questions

How can refugees enter Germany in 2024?

Ukrainians can enter Germany without a visa with a biometric passport. They can stay in the country without additional permits for 90 days, but during this period, refugees are required to apply for a residence permit (usually a residence permit according to § 24, paragraph 1, of the Residence Act) at the local foreigners' office. Since Ukrainians have no influence on how long it will take the authorities to process the application for a residence permit, it is sufficient to submit the application within the 90-day period, and this will guarantee legal residence in Germany until the application is processed.
