To use Ukrainian tax documents legally outside the country, citizens must undergo the apostille certification process. An apostille certifies the document’s authenticity and allows it to be used in countries that are parties to the Hague Convention. However, in some cases, applicants may be denied an apostille.


The State Tax Service of Ukraine explained which errors most often cause problems when applying for an apostille on tax documents.




What documents are required to obtain an apostille?


To obtain an apostille for documents falling under the jurisdiction of the State Tax Service, you must prepare a standard set of documents. It includes:


- the original document or an officially certified copy;

- proof of payment for the administrative service or a document confirming exemption from payment;

- an application from the document owner or their representative.


As of now, the cost of the apostille service is 51 hryvnia.


Why might an apostille be denied for tax documents?


One of the main reasons for refusal is the document’s non-compliance with established requirements. If the document is improperly formatted or damaged, an apostille may not be issued.


The most common reasons for refusal are:


lack of required details;

non-compliance with the official document format;

poor condition of the document or illegible text;

the presence of corrections, crossings-out, or third-party annotations;

documents filled out in pencil;

copies received by fax.


In addition, an apostille is not issued for documents that are not included in the list of those that the State Tax Service is authorized to certify.

In which cases might a document be rejected due to suspicion of forgery


Specialists may refuse to issue an apostille if there are doubts regarding the document’s authenticity. For example, if it is impossible to verify:


the authenticity of the signature;

the seal impression;

the authority of the official who issued the document.


Problems may also arise due to technical reasons or the absence of necessary samples for verification.


Which documents are not apostilled?


Certain categories of documents are not subject to apostille at all. These include, in particular:


regulatory and legal acts;

copies of laws and other official documents;

legal opinions and clarifications;

official or private correspondence.


Before submitting documents, Ukrainians are advised to check that they are properly formatted and ensure that the document meets current requirements. This will help avoid rejection and save time when obtaining an apostille for use abroad.
