Since the outbreak of the war, many Ukrainians have found temporary refuge in European countries, including Spain, which has introduced a temporary protection program for refugees from Ukraine. But what to do if temporary protection expires or if your application for it is denied? Let's consider the options for legalization in Spain in such situations.

What is temporary protection and who is it granted to?


Temporary protection allows Ukrainian citizens who fled the country due to the war to obtain the right to live, work, medical care and education in Spain. It was introduced by the European Union in March 2022 and is valid until March 2025, with possible extensions if necessary.


In order to obtain temporary protection, you need to provide proof of Ukrainian citizenship and justify the reasons for moving. Temporary protection is not always granted automatically, and it may not be extended after a certain period of time. In this case, you can use other legalization options.

How to get a residence permit in Spain - possible options


Legalization through employment


If you have a job or have found an employer who is ready to officially employ you, this is one of the most effective ways to legalize. There are several main options:


● Employment contract: The Spanish employer can apply for a residence and work permit for the foreigner. This also applies to seasonal work, for example, in agriculture.

● Self-employment (Autónomo): If you want to work as a self-employed person, register as an autónomo and open a business. You will need a business plan, financial resources, and a justification that your business will be beneficial to the Spanish economy.


Legalization through study


Spain allows foreigners to obtain a residence permit on the basis of studies. To do this, you need to enroll in an educational institution that is officially recognized. Such a permit gives the right to reside in Spain for the period of study and can be changed to a work permit after graduation.


Legalization through Arraigo (rooting)


The Arraigo program grants the right to reside in Spain to persons who have lived in the country illegally for more than three years or have close social, family or labor ties with Spanish society. There are several types of arraigo:


● Social rooting (Arraigo Social): Suitable for persons who have lived in Spain for three years, have a job or proof of social ties (recommendations from charitable organizations, for example).

● Employment (Arraigo Laboral): If you have been working illegally for more than six months and can prove an employment relationship, this gives grounds for obtaining a residence permit.

● Family rooting (Arraigo Familiar): Granted to citizens who have family ties to Spaniards or persons with permanent residence.

Legalization through marriage or partnership


Marriage to a Spanish citizen or a person with a residence permit can grant the right to reside. It is also possible to form a so-called registered partnership (Pareja de Hecho), which also allows you to obtain a residence permit.


Legalization through international protection (asylum)


Ukrainians who have been denied temporary protection can apply for political asylum, although this is a complicated process, as it requires proof of persecution or serious risks in their home country. However, war can be considered as a justification for applying.

Legalization through investment or entrepreneurship


Spain offers a “golden visa” program for investors. To obtain it, you need to invest in the Spanish economy (for example, purchase of real estate worth 500,000 euros or more or other large investments). You can also start a business if it will have a positive impact on the country's economy.
