Deprivation of a driver's license is one of the most serious punishments for car owners. Polish legislation has approved several special cases when a driver's license can be revoked. Moreover, this will take place without a trial, but based on the decision of the headman, which he will make based on the information of the police. The ban is usually temporary, usually 3 months. The procedure for deprivation of rights is clearly prescribed in the Law on drivers of vehicles (art. 102 ust. 1).

For what offenses can a driver's license be revoked in Poland? Details in our material.

For speeding

On the basis of art. 102 paragraph 1 pkt 4 of the Act on drivers of vehicles in Poland, the mayor has the right to block the driver's document in the CEPiK system, if the car owner exceeds the maximum permissible driving speed of the vehicle within the limits of the settlement by more than 50 km/h. The term of punishment is 3 months.

In addition, the driver will have to pay a fine and receive penalty points:

  - for exceeding the speed by 51-60 km/h - a fine of PLN 1,500 and 13 penalty points;

- if the speed is higher by 61-70 km/h - a fine of PLN 2,000 and 14 penalty points;

- if the speed is exceeded by more than 71 km/h - a fine of PLN 2,500 and 15 penalty points.

The term of deprivation of rights to drive a vehicle may increase to 6 months if the car owner is repeatedly stopped for speeding within the limits of populated areas. The punishment can also be extended if the driver violates the ban and gets behind the wheel without a license. These cases are prescribed in art. 102 paragraph 1d of the Law on drivers of vehicles.

A third offense will result in a total driving ban. The length of the punishment will be determined by the court.

For transporting a larger number of passengers than stipulated by the permit documents

Rights for 3 months can be taken away from the driver who transports more passengers in the vehicle than the number of seats indicated in the registration certificate or if the transportation takes place in a vehicle that is not suitable for transporting people.

In art. 102 paragraph 1a of the Law on drivers of vehicles states that you can lose your rights if you transport more than three people than is permissible on the basis of the registration certificate. The law covers not only cars, but also trucks, trailers, agricultural tractors or low-speed vehicles.

In addition to the administrative decision to suspend the validity of the driver's license, the violator will be obliged to pay a fine of 300 zlotys for each extra passenger, but its amount cannot exceed 3,000 zlotys. In addition, the driver will be charged from 6 to 15 penalty points. Their exact number also depends on the number of extra passengers.
