The U.S. Department of Homeland Security (DHS) has announced the extension of Temporary Protected Status (TPS) for Ukrainian citizens until October 19, 2026.


The decision applies to Ukrainians who arrived in the United States before August 16, 2023. The extension of TPS status will allow this category of persons to legally stay in the country and obtain a work permit.


Reasons for the TPS extension


The decision to extend the TPS status is justified by the consequences of the war in Ukraine, which has caused large-scale destruction and a humanitarian crisis. The Russian invasion has forced millions of Ukrainians to flee their homes. For many, returning to Ukraine remains impossible due to:


- Lack of security due to the hostilities;

- Destruction of critical infrastructure;

- High risk to life due to ongoing shelling.


The Department of Homeland Security emphasizes that the United States supports Ukrainians in difficult times and creates conditions to ensure their basic rights.

Who can re-register for TPS?


Under the new rules, re-registration for TPS is possible for Ukrainians who


- Are in the United States as of August 16, 2023.

- Have already received TPS status based on previous extensions.

- Meet all U.S. national security and public safety criteria.


Please note! Re-registration is required if the previous TPS status expires.

An automatic extension of the employment authorization (EAD) is possible for 12 months if the documents expire before the new applications are processed.


Individuals who pose a threat to national security or have been convicted of serious crimes are not eligible for TPS.

TPS extension procedure


To extend TPS status, you must:


1. Apply for re-registration with the US Citizenship and Immigration Services (USCIS).

2. Provide the necessary documents, including proof of residence in the United States until August 16, 2023.

3. Pay the required fees or provide an application for a waiver.


USCIS reviews each application for eligibility and security.


Ukrainians in the United States: current entry rules


Citizens of Ukraine wishing to enter the United States should consider the following rules:


1. Humanitarian Parole: The Uniting for Ukraine program allows Ukrainians to obtain temporary protection in the United States if they have a financial sponsor in the country. The period of stay is up to 2 years.

2. Tourist visa: For a short-term stay, a B1/B2 visa is required.

3. Refugees and asylum: Persons who are persecuted can apply for asylum. However, the application process takes a long time.

4. Compliance with the visa regime: After the expiration of the authorized period of stay, it is necessary to either leave the United States or apply for an extension of status.
